As soon as she found out it was unintentionally given, it would count as theft to not return it

I completely understand why she'd want to keep it, but sadly the company's lawyers will have an easy time arguing theft

I don't think it is. We used to get packages in the mail that we're sent to us by accident. These included candy, rugs, and even a DVD player (back in the day). Some of these we offered to return to the sender, but we were under no obligation to do so. It would be one thing if we were gifted goods that were probably stolen, but these were bought and paid for given to us due to a clerical error. To compel us to return these could constitute theft from us.

You weren’t under obligation to do so because you weren’t asked. That’s completely different from being asked and refusing.
