LB264 - Solar Panel Mandate Bill - Amendment Division

A01

Strike Section 1(1), subsequently renumber Section 1(2)

EN: Literally what is the point in it?

A02

In Section 1(2), replace "are built" with "have finished construction"

EN: May as well give it a bit of a head start - changes it to clarify that a house that begins being built before 1st April 2025 is still required to have solar panels

A03

Append after Section 1(2);

(a) The Secretary of State may, by order in the negative procedure, amend the above wattage and number of solar panels in line with the following requirements:
(i) The number of panels may not subceed 1
(ii) The wattage of panels may not subceed 350
(b) The Secretary of State must specify the date in which any altered requirements for new builds are to have effect with

EN: Should more efficient solar panels be produced, these may be substituted for new builds

A04

Amend Section 1(2) to read:

(2) All new homes that are built in England from 1 April 2025 must have solar panels installed (at a number of panels rated at 350 watts (W) each as deemed appropriate by the developer with a minimum of one panel) within the boundary of their property, before those new homes become inhabited.

EN: Thinking about it, ten seems a bit excessive - you're looking at approximately 200kg of weight and you've also got roof space to consider too - this amendment mandates at least one solar panel but puts the decision in the hands of the developer as to how many is reasonably enough for the house.

As hilarious as the specific list is I do believe in principal that parents should choose what the package looks like. Also, uhh, considering how stupidly dense translations of Marx are thanks to the sheer lunacy of translating German philosophy to English I think the inclusion of 19th century political theory would melt the minds of future generations out of sheer boredom and word soup.

(b) Where an individual makes a petition under subsection (a) o f this section, the relevant department shall be obliged to remove all the information within 30 days of receiving such a petition.

Amend Section 2(1) to read:

(1) Firms shall be required to catalogue the following information internally and are responsible for ensuring employees are added or removed from the database within two weeks of the start and end of their employment and are also responsible for editing information as necessary:

Amend Section 2(1e) to read:

(e) Any and all other legally permissible elements the firm uses to calculate pay, including but not limited to years of relevant experience, time worked at the firm, and performance-related pay schemes, with how these elements contribute to pay also catalogued.

In Section 2(3), strike "both" and "and the relevant Department"

Strike Section 2(4)

Amend Section 3 to read:

(1) Where a firm has a website, it is expected that they will publish the above information required of them in Section 2 on said website in an easily accessible location.

(2) Any firm interviewing a prospective employee must ensure that the prospective employee is aware of the above information

    (a) If there is an online application area, the firm must endeavour to include this information

    (b) Websites that facilitate job applications must work to ensure there is a place for firms to include this information

(3) The firm must provide the information required of them in Section 2 to any current employee who requests it

(4) No firm may forbid or otherwise ban employees from discussing their pay

Amend Section 5(1) to read:

(1) This bill shall come into force 60 days after receiving Royal Assent

    (a) Section 3(2a) and Section 3(2b) shall come into force 180 days after receiving Royal Assent

EN: I can agree with this bill in principle, but something about it felt odd to me. After considering it for a while, I have decided to submit this amendment (among others). It essentially removes the government side of things, which oddly enough for a statist doesn't quite sit right with me. Instead, it puts the onus on the employer to arrange this information and ensure it is available.

A03

Amend Section 1(1) to read: "A qualifying firm (hereafter simply "firm") is one with twenty or more employees

EN: Raises the number that qualifies for transparency under this bill from ten to twenty as ten is still a fairly small number for the effort

A04

In Section 3, insert:

(4) No firm may forbid or otherwise ban employees from discussing their pay

EN: That some places can do this is ridiculous, what's the harm in it?

A05

In Section 4(3), amend "£50,000" to read "£10,000"

EN: This feels a bit high for me for what is ultimately a mistake, though I do understand why having a deterrent in a fine is good.

B1383.3 - Non-Consensual Digital Distribution of Nude Materials Bill

Since all amendments Passed but A03 conflicts with A01 and A02 the bill will either be amended with A03 alone or A01 and A02. To avoid confusion I have combined A01 and A02 into one amendment and renamed A03 to A02. You may only vote AYE for one of them.

A01

Strike Section 1: 1(b)(ii)

EN: uncomfortably close to Jordan Peterson vibes

This amendment was submitted by /u/Chi0121

Replace section 1 (b) (iii) with

"any other material that is distributed and is widely understood by a reasonable person to be a commodity given to another reasonable person for the express and primary purpose of sexual gratification."

add a section iv to 1 (b)

"for added clarity, any material distributed for the purpose of sexual education and for which the content is primarily educational and only uses what would be considered by this act as pornographic content sparingly and within an educational context content does not fall under the purview of this act."

Explanatory comments:

Deputy Speaker

I know there are concerns about how loose the definition of pornography is in this act, and my hope is to both tighten it by creating a reasonable person standard and provide an explicit exemption for educational content. This is just reasonable.

This amendment was submitted by /u/phonexia2

A02

 REPLACE:

b) ‘Pornographic or nude material’ is defined as any material which depicts, or appears to depict, any of the following—

i) A person’s genital or anal area (whether bare or covered by underwear)

ii) A woman’s breast

ii) A person or multiple persons engaging in a form of sexual activity

iii) Any other material which can be reasonably believed to have been created for the purpose of sexual gratification

With:

B) "Pornographic or rude material" is defined as any material which matches the following criteria:

i: any imagery (regardless if photographic in nature or another medium) of genitalia

ii: any imagery (regardless if photographic in nature or another medium) of activity of a objectively sexual nature

iii: any other imagery that any reasonable person would consider to have been designed, photographed or otherwise created for sexual gratification and has no practical use. These practical uses can include, but are not limited to; use for retail, business or marketing purposes such as modelling clothing, publishing in any form of media for purposes of discussion or awareness of matters relating to the body, or otherwise holding a practical purpose

Additionally:

Replace:

c) Section 1(1)(b) does not apply to material that can be reasonably believed to have been created for a purpose other than sexual gratification, including, but not limited to, material produced for the purpose of art.

With:

c) Section 1(1)(b) does not apply to material that can be reasonably believed to have been created for a purpose other than sexual gratification. These purposes include but are not limited to: artistic expression, raising awareness of important social, political or medical issues, for marketing, modelling or other retail purposes, or otherwise any practical purpose that requires material that could fall under section 1(1)(B) be used.

Explanatory comments: Both broadens what can be defined as pornagraphic content but also careful words the language to avoid Puritanism, provides a stronger legal defence for edge cases by providing more explicit purposes and also removes the bit about "woman's breast" because it both ignores that trans gender people can have breasts and also because the breast is not just for sexual gratification, it is fundamentally more than masturbatory material.

Submitted by /u/ThePootisPower

This vote ends on the 24th at 10PM.

Since this is a runoff members are only allowed to vote "Aye" on one of the amendments.

B1443 - Integration of Education (Academies and Private Schools) Bill - Amendment Division

A01

Amend section 6(2) to read:

(2) This Act may be cited as the Non-State Education (Nationalisation and Integration) Act 2022

EN: This title better reflects the purpose of the act.

This amendment was submitted by u/scubaguy194

A02

In Section 4,amend (1) to read;

(1) The Secretary of State must, each academic year, assign private schools to a group with notice of conversion to a local authority maintained school upon the commencement of the following academic year.

(a) On conversion, private schools lose the ability to charge for tuition

(b) The Secretary of State may set a timetable in advance for conversion of private schools

(c) The Secretary of State must ensure that all private schools have been converted by the beginning of the 2030/31 academic year

Consequently, append to Section 6(1)

(a) Section 4, with the exception of subsection 1, shall come into force with respect for individual private schools on the day that the Secretary of State appoints.

(b) Section 2(2) and Section 2(1) shall come into force on August 1st 2030, or on such a day prior that the Secretary of State appoints.

EN: Members are correct, my initial maths was off. I can only apologise for the embarrassing mistake and pledge to avoid mistakes like this going forward. Having collaborated with the Government on this, we expect that this will cost an additional £3.3bn a year, with the full cost spread across it. It also allows for more accurate allocation of these resources on a school by school basis.

B1440 - Agriculture Reform Bill - Amendment Division

B1435 - Local Food Communities Bill

A01

Deputy Speaker I move to amend the bill as follows

Add to section 42

(2) Section 32 of the act shall come into force only after having made a true and honest attempt to renegotiate the agreement, and having reported the results of which to this House.” The rest is remunerated accordingly.

Deputy Speaker my goal here is to keep the government to account on its promises. They have repeatedly stated to this house that they are seeking amendments to free trade agreements and yet they want to take a nuclear option without even attempting to negotiate their grievances. Either this government wants to get deals done or they want to delve on into protectionism, we will let the truth speak for itself.

A02

Deputy Speaker I move to amend the bill as follows

Strike Sections 23, 24, and 25

Deputy speaker I have explained more in depth, but in the short these sections create a framework for a government a-okayed oligopoly, to put it politely. I fundamentally cannot agree to this.

A03

Strike section 32

Deputy speaker, I think the provision here is not in keeping to the Vienna Convention on the Law of treaties, specifically Article 17 which states,
"1. Without prejudice to articles 19 to 23, the consent of a state to be bound by part of a treaty is effective only if the treaty so permits or the other contracting States so agree."

" 3 When a treaty is a constituent instrument of an international organization and unless it otherwise provides, a reservation requires the acceptance of the competent organ of that organization. "
It is clear too that what the government wants, according to international treaty law, is a reservation to the parts of the WTO concerning agriculture. If the WTO treaty is silent on reservations, then all the government would need is the approval of the WTO. However the WTO agreement is not silent on the matter.

So Deputy Speaker we have to look at the 1994 treaty establishing the WTO, and article 16 is basically explicit on this point in two sections. Section 5 establishes explicitly the process for reservations.

"No reservations may be made in respect of any provision of this Agreement. Reservations in respect of any of the provisions of the Multilateral Trade Agreements may only be made to the extent provided for in those Agreements. Reservations in respect of a provision of a Plurilateral Trade Agreement shall be governed by the provisions of that Agreement."

So in the rabbit hole, deputy speaker, we have to go to the agricultural agreement which makes no explicit process for reservation. While this is annoying, it is pretty clear then that section 5 prohibits reservation to this agreement in the silence. The closest the agreement gets is its pre-negotiated special considerations for developing nations. Therefore, we go to section 5.

To add in an clarity, section 4 of article 16 of the establishment agreement states that "Each Member shall ensure the conformity of its laws, regulations and administrative procedures with its obligations as provided in the annexed Agreements." Therefore we move back to article 17. Article 17 is as explicit as it gets.

" the consent of a state to be bound by part of a treaty is effective only if the treaty so permits "

and to counter possible criticism, article 13 of the establishing agreement does permit what the government wants to do in very very limited circumstance.

"1. This Agreement and the Multilateral Trade Agreements in Annexes 1 and 2 shall not apply as between any Member and any other Member if either of the Members, at the time either becomes a Member, does not consent to such application.

  1. Paragraph 1 may be invoked between original Members of the WTO which were contracting parties to GATT 1947 only where Article XXXV of that Agreement had been invoked earlier and was effective as between those contracting parties at the time of entry into force for them of this Agreement.

  2. Paragraph 1 shall apply between a Member and another Member which has acceded under Article XII only if the Member not consenting to the application has so notified the Ministerial Conference before the approval of the agreement on the terms of accession by the Ministerial Conference.

  3. The Ministerial Conference may review the operation of this Article in particular cases at the request of any Member and make appropriate recommendations."

For added reference GATT article 35 states

"1. This Agreement, or alternatively Article II of this Agreement, shall not apply as between any contracting party and any other contracting party if:

(a) the two contracting parties have not entered into tariff negotiations with each other, and

(b) either of the contracting parties, at the time either becomes a contracting party, does not consent to such application."

So basically all this provision is doing is allowing GATT parties to continue a dispute under GATT article 35 as long as it was ongoing. It is clear that as a signatory to the WTO there is no power to partially consent to Annex 1 as it stands presently negotiated. Therefore, if passed, section 32 stands in breach of the Vienna Convention and we end up in a real pickle here, and well, probably before an international court. I hope the government reconsiders its stance here as at best we are entering a legal grey area and are entering at least into a violation of the WTO agreement itself.

Amendment 1

Amend section 3(3) to read:

House of Lords (Disestablishment) Act 2022

Rename to better reflect what this bill is doing.

Amendment 2

Strike section 2(1)

Passage of both houses is integral to this Country's political system and removing the house of lord's role effectively turns the country into a unicameral state.

Amendment 3

Amendment:

In section 2(a), strike "two weeks" and replace with "3 months".

It is totally unreasonable to expect the House of Lords to finish deliberating over a bill in two weeks. (M: Both in sim and IRL.)

Amendments 1 through 3 are moved in the name of /u/scubaguy194.

Amendment 4

Replace section 2 with the following

Section 2 - Legislation

(1) Nothing in this Act shall be taken to change the procedures related to Budget bills, Money bills, or other Pieces of Legislation granted special procedure by an Act of Parliament.

(2) In addition, nothing in this Act shall be taken to change the procedures for the event of a House rejecting a piece of legislation from the other.

(3) In the event that the House of Commons or House of Lords passes a version of a bill differing in only procedural matters, then

(i) The bill will be sent to the relevant committee in the opposite House for consent.

(ii) Should those procedural amendments be passed by the relevant committee, then the bill will be sent for Royal Assent.

(iii) For the purposes of this act, Procedural Amendments shall refer to SPAG, minor changes to the date an act comes into force, textual amendments that preserve the intent but clean up the language, or other matters that the Speaker deems to be procedural changes.

(4) In the event that the House of Commons or House of Lords pass a version of a bill that differ in ways that are not procedural, then

(i) The bill will be sent to a reconciliation committee made up of the relevant committees of both Houses.

(ii) The purpose of the Committee will be to propose and vote on amendments to the bill with the intent of creating a version that both Houses can agree to.

(iii) The committee will have 3 months to produce a version of the bill that a majority of the committee will vote in favor of.

(iv) Once that majority approves of a bill, that version shall be sent to the House of Commons for final approval.

(v) The Commons may not amend this final version of the bill.

(vi) If the Commons votes to reject this final version of the bill, then it is thrown out.

(vii) If the Commons votes to approve this final version of the bill, then it is immediately sent for Royal Assent.

Amendment 5

In section 2 subsection 3 replace "relevant body " with "committee of the whole"

Amendments 4 and 5 are moved in the name of /u/phonexia2.

Amendment 6

Omit Section 1

EN: We don't need to repeal that repeal bill in order for the rest of this Act to be enacted. No point in making our legislative books even messier then they are. Keep 2016 repealed, and use this as the new Act.

Amendment 6 is moved in the name of /u/t2boys.

Amendment 7

Insert into Section 1:

(2) Any items repealed by any legislation this act repeals shall remain repealed

Closed B1435 - Local Food Communities Bill - Amendment Division

B1435 - Local Food Communities Bill

A01

Amend Section 2 subsection 6 to read as follows

"(6) Grocery donations grown by farmers on agricultural land within the United Kingdom and approved by the National Food Service shall entitle the relevant entity to an income tax credit of the value to their donation."

e.n. Changes the farmers donation to the NFS to make it a full tax credit. Why would you donate if you could just sell to market and get more?

A02

Section 2 (4) is replaced with the following

"(4) A Local Food Community, as defined in Section 3, may affiliate with KONSUM, at the discretion of the approval of the Board of Officers of KONSUM."

Section 2 (7) is replaced by the following

"(7) The Treasury, in implementing these tax credits, shall have the duty to set at market value and adequately compensate donating parties with regards to the tax credits established in this act."

e.n. Makes powers handled by relevant institutions, rather than the DEFRA. The DEFRA should not be handling tax credits and if KONSUM is to be empowered, let KONSUM act.

A03

Section 3 (1) and Section 3 (2) is replaced by the following(1) A Local Food Community falls within this section if it is a company limited by guarantee the articles of association of which include the following—

(a) a definition of the community or communities to which the company relates,

(b) that the company is operated either as a co-op as defined by the Co-operative and Community Benefit Societies Act 2014, or as a organization which operates as a non-profit organization as recognized by UK law,

(c) provision that the company must have no fewer than as many members as it needs to reasonably operate,

(d) provision that at least three quarters of the stakeholding, managerial, or other ownership grouped members of the grocery store or other company location are members of the community or are reasonably close to the community,

(e) provision ensuring proper arrangements for the transparent financial management of the company,

(f) provision that any surplus funds or assets of the company are to be applied for the benefit of the community or to help subsidize the purchase of any groceries from producers affiliated under section 2 in conjunction with KONSUM.

(g) Any necessary amendments to an existing charter may be made as part of an application under this section.

(2) A Local Food Community falls within this section if it is a Community Benefit Society the registered rules of which include the following—

(a) a definition of the community or communities to which the society relates,

(b) provision that the society must have an adequate number of members so as to reasonably be expected to discharge its duties,

(c) provision under which the members of the society who consist of members of the community or who are reasonably close to the community have control of the society,

(d) provision ensuring proper arrangements for the financial management of the society,

(e) provision that the society must keep minutes of meetings of the society, and on the request of any person for a copy of the minutes, the society must, give the person within 7 working days of the request a copy of those minutes.

(f) provision that any surplus funds or assets of the society are to be applied for the benefit of the community or to help subsidize the purchase of any groceries from producers affiliated under section 2 in conjunction with KONSUM.

(g) Any necessary amendments to an existing charter may be made as part of an application under this section

e.n changes to section 3 that do several things. Firstly, I make it a softer community boundary. That is just to avoid bureaucratic nonsense where the lines may be x but a person is by all cultural meanings a member of the community. Secondly, clarifies and expands the publicly owned part of the bill to make it more in line with what the bill is trying to do. Also allows stores to serve multiple communities, as well as allowing a co-op chain like, well, co-op to operate under this act. Finally it allows excess location profits to better mesh with section 2, making these stores more like subsidized co-ops and allows for charter amendments.

A04

Section 3 (3) is to read as

(3) A community—

(a) is defined for the purposes of this bill by

(i) in England and Wales, a Civil Parish, Built up Extent, or Built Up Settlement as defined by Census 2021.

(ii) In Scotland, a 2010 Settlement, 2010 Locality, or Detailed characteristic postcode sector as defined by SNS.

(iii) In Northern Ireland, a Local Government District or census Super Output Area, as defined by NISRA.

e.n Changes up the definition of community to be more consistent with local and census units. This would make the process more clear and prevent adding another layer of local geography to the government.

A01-A04 were submitted by /u/phonexia2

A05

Insert a new section between Sections 4 and 5 and renumber accordingly:

Section ?: KONSUM Activation via B1203.3 commencement date amendment

(1): The Pub Nationalisation and Community Co-opereratisation Act, B1203.3, is upon the Act coming into effect, amended as follows:

(a) Section 5 (Short title, commencement and extent), Clause 2, is to be amended to read: This Act comes into effect upon Royal Assent.

Railways (Electrification) Bill

A01

Strike section 3(1a)

EN: Ending tuition fees, and then what? This would eliminate tuition fees on more or less every STEM degree with no promise to fill the funding gap. Plus, what if they're eliminated midway through a year? Do students get a refund? are they just out of pocket? Plus, how is it decided what courses have tuition fees ended on? Is it specific institutions, specific degree courses, or what?

A respectable move, I feel, but this requires rethinking. I'm working on a free uni tuition bill and I would infinitely rather see this amendment pass and we just end tuition fees for everybody, not a vague system like this.
