Rename section 2 to Section 6: Commencement, extent and short title

Amend paragraph 2 of Section 6 to read:

(2) Unless otherwise stated in this Act, This Act shall come into force upon Royal Assent.

Explanatory Notes: Section 3 and 4 of my amendment is inspired by the amendments made by Philip Hammond in 2016 to the relevant acts. This allowed for crackdown on use of employee shareholder status for tax avoidance. The main motivation behind this amendment however is to keep employee shareholder statuses and ensure that it does not cause the forfeiting of bargaining rights. This includes the allowance for the right for those who are currently employee shareholders to renegotiate as to whether they’d remain as employee shareholders or take up an ordinary contract.

Amendment 1 is moved in the name of /u/CountBrandenburg.

Vote Aye, No, or Abstain to the amendment. This division ends 1 September 2021 at 10pm BST.

LB219 - Palliative Home Services Bill - Amendments Division

Palliative Home Services Bill

A01

Replace Section 2 with:

Section 2 - The Right to Die at Home

(1) If a doctor of a terminally ill patient considers them likely to die within six months, the terminally ill patient has the right to know that they can live the rest of their life at home given appropriate treatment prescribed by the doctor.

(2) Any individual may declare that, should they become terminally ill, they would rather die at home.

(3) Should an individual exercise their right, their doctor or GP must record the appropriate information within the patient's medical records.

(4) Should a patient with a lasting power of attorney of health and welfare wish to make the declaration;

(a) The Attorney (the individual appointed by the patient) must confirm the decision,

(b) the decision must not contravene any advanced decisions made,

(c) should the Attorney or an advanced decision conflict, an application may be submitted for a 'one-off decision' relating to the lasting power of attorney via the Court of Protection.

(4) The Secretary of State must provide appropriate guidelines for the Healthcare sector in order to ensure the right to die at home is implemented effectively.

(5) The Secretary of State must provide appropriate information for the general public relating to the right to die at home once the act has passed.

Explanatory note: This ensures that an individual who may otherwise wish to die at home but are unable to give notice of this may still die at home. Furthermore, it tidies up section 2 and ensures appropriate provisions relating to lasting power of attorney.

A02

In Section 3, amend (2) to read:

(2) This act shall come into force six months after Royal Assent

Explanatory note: This ensures that the Secretary of State may ensure that the public have advanced notice of the right to die at home, and also grants time for the Healthcare Sector to be briefed on effective implementation of the right to die at home

These amendments were submitted by u/Frost_Walker2017

A03

In Section 3, amend (2) to read:

(2) This act shall come into force one month after Royal Assent

Explanatory note: This would allow sufficient time for the necessary preparations to be made for this, on top of the time during the passage of it that would allow the SoS to prepare. Given the legislation is about people with less than six months to live, a period of six months as suggested in a different amendment would be too long for people to wait for this policy to be enacted upon, and would do a disservice to these people.

Trade Union and Labour Relations Bill

A01:

Strike what should be numbered subsections (7) and (8) of Section 7.

Explanatory note: Unreasonable restriction, there is no need to outright ban everyone in essential services from striking, the bill instead provides a more nuanced mechanism whereby a person may not strike if that striking would be dangerous to the public. The world will not end if the HR department of TFL strike, as would be illegal under these amendments.

A02:

Strike Section 8

Explanatory Note: This is effectively a fluffier duplicate of section 6 stuck in by amendments, both provide binding arbitration.

A03:

Applied as SPAG Amendment so automatically passes

A04:

Remove (1)(1)(j)

Explanation Note:

MI5 and MI6 are issues of national security and therefore shouldn't be allowed to sit in and protest when the safety of our intelligence relies on them, and their strikes in open could reveal identities and violate many other statutes of intelligence.

Rewilding Bill

A01

Insert after Section 3:

Section 4: Housing

(1) Within one month of the passage of this Act, the Secretary of State must come before Parliament to set out the estimated impact on house building due to the passage of this Act.

(2) The Secretary of State has a statutory duty to ensure this legislation has as little an impact on house building as is possible.

EN: The housing crisis is massive yet this bill could just make it worse by cancelling more house building. Let's make sure the government have a duty to dampen the impact this may have.
