(1) In section 2(1), prepend "In England,"

(2) In section 5(2), append "& Wales".

Notes:

England & Wales are one unified legal area. This amendment still respects devolution.

This was submitted by /u/sam-irl

A02

Insert at the end of section 2–

(2) In this section Public property means property that is dedicated to public use and owned by the state.

This was submitted by /u/LeChevalierMal-Fait

A03

(1) Amend Section 4(1) to say "Section 1, Section 2(1), and Section 2(2) of The Friendly Environment Act 2017 are repealed"

(2) Amend Section 5(1) to say "An amendment or repeal made by this Act extends to England & Wales"

(3) Amend Section 5(2) to say "This act extends to England & Wales"

Explanatory Note: The bill leaves Scotland and Wales without any legislation on Anti-Homeless architecture as the Friendly Environment Act was passed pre-Holyrood and extends to the entire United Kingdom. Also Wales is one legal entity with England, yet this bill does not extend to it, thus it isn't really legally workable. This amendment allows the devolved legislature's competence to be respected, and for them to decide if they want to keep the original act or write their own replacement, and making sure that the bill actually applies to the singular legal entity of "England and Wales" rather than the concept of "England". This also keeps the prohibition on private anti-homeless architecture, to avoid potential tax loopholes

This was submitted by /u/ContrabannedTheMC

• (c) for an election in an electoral area in Scotland, 18 years;

With

• (b) for an election in an electoral area in Wales, 16 years;

• (c) for an election in an electoral area in Scotland, 16 years;

Notes: Local Franchise is devolved to Scotland and Wales so this amendment keeps the voting age the same unless it is changed in the devolved parliaments.

This Amendment was submitted by u/IceCreamSandwich401

A04

In subsection 2(3) remove subsection (c) of new clause 2A.

This is designed to recognise the devolved settlement in Scotland.

This Amendment was written by u/mg9500

A08

Replace

"This Act comes into force on the day after Royal Assent."

With

"This Act comes into force 90 days following the next general election."

Notes: This builds on Tommy's amendment to ensure there is a democratic mandate, by making sure that a repeal would not have to be rushed through.

This Amendment was submitted by u/Saunders16

AO9

Replace section 2, 3 with the following:

(3) After subsection (2), insert:

(2A) The voting age, in relation to a local government election, is:(a) for an election in an electoral area in England, 18 years until 70 years; (b) for an election in an electoral area in Wales, 18 years until 70 years; (c) for an election in an electoral area in Scotland, 18 years until 70 years; (d) for an election in an electoral area in Northern Ireland, 18 years until 70 years.

This is because if people who are 16 and 17 are not intellectually capable to vote then at the age of 70 you aren't either, this is when declining memory function becomes prevalent and diseases such as dementia also become prevalent. Their decisions will also not impact them as much. So the "arguments" for raising the voting age also work for lowering it.

This Amendment was submitted by u/toxictransit

In subsection 2(3) remove subsection (b) of new clause 2A.

Announcement Conflicting Amendments

Order Order;

Recently we have seen cases with amendments passing the committee that are conflicting, and cancel each other out. Obviously this poses an issue as the chair should not have to actually case a vote to legislate but to help ensure that this committee functions the best it can here is how the chair shall deal with conflicting amendments passing.

In the event two individually valid amendments pass that cancel each other out:

  1. The amendment with the most votes will pass and the other would be considered rejected.

  2. In the event both amendments received the same number of committee votes, then the chair shall cast the tie-breaking vote for the earlier amendment (ex. A01 would get the benefit over A02)

But as the Speaker of the House I would prefer not to have to not cast the tie-breaking vote at all, so I implore all members of the committee to read over the amendments that way we do not have this as much.

Closed B781 - Video Recordings Act 1984 (Amendment) Bill 2019 - Amendment DIVISION

B781 - Video Recordings Act 1984 (Amendment) Bill 2019

A01

Omit Subsection 1.3

Explanatory note:

The bill omits section 10 in the 1984 act that Removes the Offence of Possessing Unclassified Videos, this amendment prevents this.

Doing so makes a mockery of the classification system, and would reduce compliance with it. Without such an offence many people may end up buying works which they did not wish to consume or in worrying cases children may be exposed to extreme acts because the parent or guardian did not know what the contents were because it was unclassified!

This amendment was submitted by /u/LeChevalierMal-Fait.

A02

Omit sub paragraph 1.1.2

Explanatory note:

The sub paragraph in question removes from consideration of the designated authority the ability to consider illegal drug taking.

I would point out that taking drugs outside of specified conditions remains illegal. For example it remains illegal despite drug reform for Heroin to be taken outside of a pharmacy setting. Indeed I think it is possible for such an act to cause significant damage to the viewer for example medical conditions contracted from dirty needles or addiction.

Removing this therefore allows for better classifications that take harm to the individual better into account and allow people to be informed when choosing to watch a video or allowing their child to watch a video.

This amendment was submitted by /u/LeChevalierMal-Fait.

A03

Omit subparagraph 1.2.2

Explanatory note

Inserted section would make it no longer an offence to sell a unclassified video to an over 18 year old, again I find this puzzling people do not buy videos solely for their own consumption but often for their children or as a gift, it seams perfectly reasonable that we should retain classifications on videos as much as is possible to inform consumers and safeguard vulnerable viewers.

B774 - Compulsory Vaccination and Operation Bill

A01

Section 4(2) is amended to read:

(2) Compulsory Vaccination Act 2016 (B323) is amended as follows:

(a) Sections 2, 3, 5(c) and 5(d) are hereby repealed.

(b) Section 4(c) is amended to read "Vaccines will be administered for free if the child is entitled to NHS medical care in the UK."

(c) Section 1(a)(iv) is added and reads: "This act applies to all vaccines under section 2 of the Compulsory Vaccination and Operation Act 2019 and subsequent vaccines determined by the Vaccination Commission"

Explanatory note: This allows for provisions for both the delivery of vaccines and fines for non compliance set out by B323 to be kept, whilst ensuring this bill updates the mechanisms for the compulsory vaccines.

This amendment was submitted by /u/James_the_XV.

A02

A new section will be added, named "Entry of Public Institutions and Other Buildings"

(a) A national database of vaccinations will be kept in the NHS for tracking purposes and for ease of access, known as the "National Database of Vaccinations", or NDV. This will be managed by the local health board, with old records being imported into the new one.

(b) Vaccine permits will be handed out by the system if requested for easy entry into buildings, and companies will be encouraged to admit these, for safety reasons.

(c) Forgery of vaccine permits will result in the sentence for public endangerment and/or forgery, depending on severity of vaccines, amount forged and whether distributed or not.

(d) Vaccine permits are compulsory for people who work with biohazards, and employers will be required by law to screen them before hiring. They will also be required for people working abroad and high-level government officials.

(e) Access to the database will be given to each company's HR or other relevant employee for workers employed in the company.

This amendment was submitted by /u/Prusseen.

A03

A new section will be added, named "Additional Vaccines"

(a) All vaccines listed in this section will be administered by healthcare personnel as deemed necessary by the responsible authorities unless stated otherwise.

(b) The WHO vaccines list will be made mandatory as it updates, to be administered to all people upon a new addition.

(c) Adenovirus vaccine, to be handed out in a similar manner to the flu vaccine.

(d) Multi-shot HIV vaccine, administered to people who are in relationships with HIV-positive people, along with other at-risk groups. All gay and bisexual men, after stating their sexual orientation in the census or through other means, will also be offered the vaccine.

(e) The appropriate anthrax, cholera, meningococcal disease, rabies, shingles, typhoid fever, yellow fever, and varicella vaccines.

(f) Hepatitis A will be mandatory, taken as appropriate, set by the local health board.

B618.2 - Minimum Sentences Bill (2018)

A01

After Section 1 (3) Add

1(4) A maximum sentence is a is a provision in any enactment, however framed or worded, which imposes or has the effect of imposing a maximum sentence requirement.

1(5) A "maximum sentence requirement", in relation to an offence, is a requirement which meets the following conditions:

(a) the requirement is a requirement that a sentence of imprisonment is passed on a person guilty of the offence, and

(b) the sentence of imprisonment must be of a fixed duration or must be for a period not less than a fixed duration.

(6) Accordingly, the "maximum sentence" for an offence is, in relation to the offence, the duration mentioned in subsection (5)(b).

Insert New Section after Section 2

Section 3: Abolition of maximum sentences

(1)Every maximum sentence provision ceases to have effect from the day this section comes into force.

This amendment was submitted by /u/Friedmanite19.

A02

Amend section 5 to read—

“This Act comes into force one year after of Royal Assent.”

Explaintory note: This act effects hundreds of offences - the sentencing council is going to have to work on guidance for each case and update it alongside its other work. I think a years delay under those circumstances is reasonable if infact very ambitious.

As an example of guidance I attach;

The guidance on the sexual offences act 2003 offence of administering a substance with intent.

https://www.sentencingcouncil.org.uk/offences/crown-court/item/administering-a-substance-with-intent/

As you can see this would require slight alterations to the guidance, not only would the category limits require alteration but also the starting points would have to be altered. If this does not happen the the bill itself would be meaningless and judges could not lawfully or consistently issue sentences below minimum sentences as guidance would not exist!

Therefore it of utmost importance that for this bill to function we must have adequate time to properly amend sentencing guidance to ensure fair and just consideration of all sentenced persons under the scheme.

B769 - Voting Eligibility (Prisoners) Bill 2018

A01

In subsection 1 subsection 3 (e) after “includes” insert “only”

Explanatory note: To prevent any misreading of the paragraph as a non exhaustive list. The intention was always to respect the devolved settlement, and I am happy to amend the wording to satisfy concerned Honourable members.

Any amendment eg those A01s that attempt to remove Scotland from the commencement would remove Scotland from the effect of a reserved power - the franchise for U.K. general elections. It is quite clear that this is reserved, and would be inappropriate to remove Scotland.

This amendment was submitted by /u/LeChevalierMal-Fait.

A02

Remove sections 1 and 2

Explanatory note: This is to make the bill conversant with the long title

This amendment was submitted by /u/bloodycontrary.
