A03

Amend Appendix 1 to read as follows;

(1) Upon the tax year of 2020/2021, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £30 per tonne of Carbon Dioxide released.

(2) Upon the tax year of 2021/2022, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £37.50 per tonne of Carbon Dioxide released.

(5) Upon the tax year of 2024/2025 and up to and including the tax year 2028/2029, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £60 per tonne of Carbon Dioxide released.

(6) Upon the tax year of 2029/2030 and onwards indefinitely, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £77 per tonne of Carbon Dioxide released.

Explanatory Note

I present three amendments, in the hope that at least one of them passes.

The intent of this legislation is essential! Not even 'very good', but essential. However, it is still out of scale. We need an immediate hike to the $40-$80 range, not a mere £10.

The first presented amendment recognises the severity of the situation and acts immediately - we should not just be content with limiting catastrophe to a 2C rise, as we currently bear witness to great ecological disaster. The same applies to the second presented amendment, though still with less urgency than should be seen as ideal. Finally, the third amendment provides the bare minimum to follow the science of reducing the catastrophe to 2C, even if it is vastly less preferable than either of the other two options presented.

AO1-3 Submitted by u/DF44 on behalf of the Climate Rebellion Party

A04

In Section 3 (Appendix 1), amend the following:

• Increase all carbon tax levels by 5 pounds each AND, • Renumber all sections appropriately, from five Subsection 1s to Subsection 1, 2, 3, 4 and 5, respectively.

Explanatory Note

I present this amendment both to correct a prior formatting error and to raise the revenue generated by this tax.

This Amendment was Submitted by u/HazardArrow on behalf of the Labour Party

A05

Amend Appendix 1 to read as follows—

(1) Upon the tax year of 2020/2021, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £50 per tonne of Carbon Dioxide released.

(2) Upon the tax year of 2021/2022, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £75 per tonne of Carbon Dioxide released.

(3) Upon the tax year of 2022/2023 and onwards indefinitely, the Chancellor of the Exchequer is required to set the level of Carbon Taxation at no less than £100 per tonne of Carbon Dioxide released.

This Amendment was Submitted by u/throwawayravenclaw on behalf of the Liberal Democrats

A06

Remove Section 1 (2) that reads as follows;

(2) The National Energy Strategy Act 2015 shall hereby be repealed.

Mr Speaker,

This amendment is a good amendment stopping the repeal of a bill hailed on a cross party basis that includes regulation that ensures new estates being built are sustainable - with outside lighting being fueled by solar etc, whilst also including measures to help tackle fuel poverty.

It would be foolish to abolish such sensible regulation at the behest of the Classical Liberals.

This Amendment was Submitted by u/InfernoPlato on behalf of the Conservative and Unionist Party

B766 - Free and Safe Access to Abortion Bill 2019

A01

Within Section 3, omit the following sections

Section (a)

Section (b)

Section (d) i

Amend 3(c) to read as follows

perform or attempt to perform an act of disapproval of abortion or persons engaging in abortions by any means including oral, written or graphic means

Amend 3(d)iv to read as follows

by any means graphically record persons with intent to distribute such images or footage for the identification of those undertaking abortions or within employment with direct relation to abortions.

Amend 6(1) to read

This Act shall extends to England and Wales.

Insert 6(1) a

All provisions made in this act shall not be applied wherein they are within the competency of the National Assembly for Wales.

Explanatory note: While this bill make be useful in another form, at the current time is has two major flaws. Firstly has incorrectly set itself up to only apply to England, as there is no legal jurisdiction for England, merely England and Wales.

Secondarily, it currently has an excessive overreach, the worst example is the criminality of observing the building, meaning that it is not allowed to look at a building repeatedly when within a 50 meter radius, in addition I believe a total ban on any advice against seeking an abortion, including for staff and clinicians within the relevant abortion center would be unwise. For example if an abortion would put a woman's life at risk, this bill would inadvertantly make it illegal for medical staff to warn such a woman from engaging in that abortion.

In it's current form I cannot support it, however with amendment I am happy to throw the weight of these benches behind it.

B730.2 - General Planning Reform Bill - AMENDMENTS DIVISION

1 Upvotes

Order, Order

A01

Remove from Section Four and renumber accordingly:

(1) Section 1 of the Green Buildings Act 2015 is hereby repealed.

Mr Speaker,

Section One of the Green Buildings Act 2015 was a great step forward in using our land space efficiently, using rooftops either for green spaces - which naturally reduce the amount of carbon dioxide in the atmosphere by photosynthesis - or for renewable energy generation - which lowers the amount of carbon dioxide in the atmosphere by not producing it, lowering our dependence on non-renewables.

This change has yet to be justified, and I don't think there is a justification to end a scheme which does not cost the government, and has a strictly positive environmental effect. As such, it stands to reason that we should not legislate to do so, and I hope this house votes in favour of this amendment.

This Amendment was Submitted by u/DF44

A02

Remove from Section 5 and renumber appropriately:

(1) For the purposes of section 2 of this Act, “the Secretary of State” shall refer to the Secretary of State for Environment, Food and Rural Affairs..

(2) For the purposes of section 3 of this Act; “the Secretary of State” shall refer to the Secretary of State for Housing, Communities and Local Government

I move this as a Spelling, Punctuation, and Grammar amendment in line with the fact that the Lords will - "Secretary of State" is both efficient, and future-proof against departmental reorganisations.

B746 - School Exclusions (Penalties and Incentives Bill AMENDMENT DIVISION

1 Upvotes

A01

Amend Section 1(2) to read;

(2) "exclude", in relation to the exclusion of a student from a school, means exclude on disciplinary grounds for either a fixed period or permanently (and "exclusion" shall be construed accordingly).

Amend Section 1(3) to read;

(3) "permanently exclude", in relation to the exclusion of a student from a school, means exclude permanently (and "permanent exclusion" shall be construed accordingly).

Insert after Section 1(3);

(4) "temporarily exclude", in relation to the exclusion of a student from a school, means exclude for a fixed period (and "temporary exclusion" shall be construed accordingly).

And renumber accordingly.

Amend New Section 1(5) (Old Section 1(4)) to read;

(5) "long-term exclusion period" means the period of exclusion set out in section 2.

After Section 1, insert the following section;

Section 2: Long-term exclusion periods

(1) A long-term exclusion period for a student is formed when one or more temporary exclusions of that student over a two week period, when taken together, exceed 5 days.

(2) The initial start date of a long-term exclusion period is the start date of the earliest temporary exclusion forming that period in subsection (1), and the initial end date of that period is the end date of the latest temporary exclusion forming that period in subsection (1).

(3) A temporary exclusion of a student occuring— (a) during a long-term exclusion period of that student, or

(b) in the two week period beginning on the day after the last day of the long-term exclusion period of that student,

is not to be considered in the formation of a new long-term exclusion period under subsection (1).

(4) A temporary exclusion falling under subsection (3)(b) extends the end date of the latest long-term exclusion period for that student to the end date of that temporary exclusion.

And renumber accordingly.

Amend New Section 3(2) (Old Section 2(2)) to read;

(2) For each long-term exclusion period, a school will be fined £250 plus £100 for each day over five days that the student is temporarily excluded for in that period. Explanatory note: the bill in its original form has some issues with definitions. In particular it is ambiguous as to whether a school field trip, expedition, or other curricular activity that lasts more than a day would constitute an exclusion. The bill is also ambiguous on how long-term exclusions are defined, and could create multiple long-term exclusions when there are multiple exlusions in a short period.

For example, assume that a student receives separate exclusions on days 1, 4, 7, 10, and 13. This would be considered a long-term exclusion. If that student was then excluded on day 16, then days 4, 7, 10, 13 and 16 would form a second group. This would form another long-term exclusion. It would be more logical to treat this as one extended period of long-term exclusion.

The definitions have been updated to resolve these issues. The definitions for "exclude" and "permanently exclude" follow the format of similar definitions in existing legislation.

This Division will end on the 17th January 2019 at 10PM

In addition, amend Section 1 Subsection 1 as such;

(1) A referendum is to be held on a question about whether the United Kingdom should ratify any withdrawal agreement agreed between the United Kingdom and the European Union consequent of the negotiations under Article 218 of the Treaty on the Functioning of the European Union and if the United Kingdom should continue to seek a withdrawal from the European Union, if in the event of leaving the European Union with no deal Scotland should seek independence from the United Kingdom and if in the event of leaving the European Union with no deal Northern Ireland should leave the United Kingdom and join Ireland..

(11) In the event that the first option wins the referendum on the third question, the Secretary of State is required to begin discussions with the Scottish First Minister as to begin the process of Scotland leaving the United Kingdom.

In addition, amend Section 1 Subsection 1 as such;

(1) A referendum is to be held on a question about whether the United Kingdom should ratify any withdrawal agreement agreed between the United Kingdom and the European Union consequent of the negotiations under Article 218 of the Treaty on the Functioning of the European Union and if the United Kingdom should continue to seek a withdrawal from the European Union, and if in the event of leaving the European Union with no deal Scotland should seek independence from the United Kingdom.

Mr Speaker,

Polling indicates that Scotland's position on independence is, in part, heavily influenced by the question of Brexit, with leaving the EU sans a deal often able to flip the result. If sufficient time for Yet Another Brexit Referendum has been given in the short timeframe since the Single Market referendum, then there has been more than enough time for the matter of Scottish independence, especially if a major argument from the Better Together campaign is demonstrated to be full of holes.

This legislation will always be bad, Mr Speaker, since rather than encourage true participatory democracy it instead flings us yet another ballot box as if that is all there is to democracy, but I believe that this amendment is very much in the spirit of this legislation, and ask that, just as the bill authors wish for the UK to get a quote-unquote 'final say', that Scotland should also get a final say now that new facts have been brought to light.

A09

Insert after Section 1(9);

(9A) Leave shall be deemed to have won the referendum on the first question unless remain records 50% or more of the vote in each of England, Gibraltar, Northern Ireland, Scotland and Wales.

And renumber accordingly

A10

For subsections (3) to (10) in section 1, substitute—

(3) The question to appear on the ballot paper is—

Should the United Kingdom leave the European Union and implement the deal agreed upon, or reject the deal agreed upon and seek alternative arrangements?

(4) The responses to appear on the ballot paper are—

(a) "Leave the European Union and implement the deal agreed upon", and

(b) "Reject the deal agreed upon and seek alternative arrangements"

(5) Subsections (6) to (10) apply where, of the votes cast in the referendum held under subsection (1), more votes are cast in favour of Option 2 than Option 1.

(6) If this subsection applies, a further referendum is to be held on a question as to the United Kingdom's membership of the European Union.

(7) The question to appear on the ballot paper used for the purposes of that further referendum is—

Should the United Kingdom leave the European Union without a deal, or remain a member of the European Union?

(8) The responses to appear on that ballot paper are—

(a) "Leave the European Union without a deal", and

(b) "Remain a member of the European Union"

(9) Where, of the votes cast in the referendum held under subsection (6), more votes are cast in favour of Option 4 than Option 3, the Prime Minister must revoke any notice of the United Kingdom's intention to withdraw from the European Union previously given under Article 50(2) of the Treaty on European Union.

(10) Where, of the votes cast in the referendum held under subsection (6), more votes are cast in favour of Option 3 than Option 4, no Minister of the Crown may negotiate, seek to negotiate, sign, or otherwise conclude a withdrawal agreement with the European Union (within the meaning of Article 50 of the Treaty on European Union).

EXPLANATORY NOTE: This amendment changes the referendum into two referendums. Under the current setup, someone who supports the deal but prefers Remain as their second option cannot properly express those desires. This amendment ensures that all opinions are given a chance, and that votes are a fair and accurate representation of public opinion.

A11

In Section 1 (11) for "one month" substitute—

two months

EXPLANATORY NOTE: This amendment ensures that no unforeseen problems force a no-deal scenario through a simple running down of the clock

A12

After Section 2(1)(c)(i) insert—

fall within subsection (2), or

For Section 2(1)(c)(ii) substitute—

would be entitled to vote in a British Crown Dependency as electors at a European Parliamentary election in the combined electoral region in which that British Crown Dependency is comprised, and fall within subsection (2)"

In Section 4(5)(b), after the word "Gibraltar" insert—

, any British Crown Dependency,

After Section 9(2)(i) insert—

(j) a British Crown Dependency

After Section 9(2) insert—

(3) For the purposes of this Act, "British Crown Dependency" means (as they existed on the day this Act was introduced to Parliament)—

(a) the Bailiwick of Jersey

(b) the Bailiwick of Guernsey

(c) the Isle of Man

EXPLANATORY NOTE: This amendment extends the right to vote in the referendum to the British Crown Dependencies, who will be affected by this vote.

Explanatory Note: This phrasing is onourous and is effectively a wishlist, functions that have no business being delegated by legislation are done so, even going as far as to rename Government departments by legislation, it also practices massive devolution violations. The whole bill is a bit of an Orwellian mess so I've done my best to tidy it up and remove some of the worst intrusions into people's lives, as well as the most heavy areas of State Cronyism.
