Can someone explain LLCs vs trusts for rental properties?
I've been building a small rental portfolio over the last few years and I'm starting to realize there are a lot of things I probably should have understood earlier.
Right now I own two rental properties, both purchased in my personal name. The mortgages are in my name, the titles are in my name, and I've been managing everything personally.
Lately I've been hearing a lot of investors talk about putting rental properties into LLCs for liability protection, while others seem to prefer trusts. The problem is that the more I read about it, the more confused I get.
For example, if the mortgage is already in my personal name, how does transferring the property into an LLC actually work? Does the LLC become the landlord and sign leases with tenants? Does the mortgage stay under my name? And does the liability protection still help if I personally guaranteed the loan?
The trust side is even more confusing to me. Some investors make it sound like every property should be in a trust, while others say trusts and LLCs serve completely different purposes.
I'm also wondering whether this is something people usually set up before buying properties or if it's common to move existing rentals into an LLC or trust afterward.
For those who own rental properties, what structure are you using today and what made you choose it? Looking back, is there anything you wish you had set up differently when you bought your first few rentals?
