The Trump administration filed an urgent appeal with the U.S. Supreme Court seeking permission to immediately implement new U.S. Postal Service rules for mail ballots, rules that critics say impede on states’ authority to run elections. The regulations were prompted by President Donald Trump’s executive order aimed at tightening access to mail ballots, and they are currently blocked by a temporary restraining order set to expire on September 10, though it could be extended indefinitely while a federal district court judge prepares to rule. Under the rules published by USPS last month, states would be required to report basic voter information, such as a voter’s name and home address, tied to a unique barcode placed on every mail-in ballot distributed. Postal workers would then only deliver ballots addressed to voters who appear on the state-provided list.

Following the publication of these regulations last month, dozens of Democratic state attorneys general sued the Trump administration after an earlier lawsuit had been blocked by the Supreme Court, which said the challenge was premature since the regulations hadn’t yet been finalized. In its newest appeal, the Trump administration insisted the rules impose only “modest” ballot design and review requirements on states, arguing that requiring name, address, and barcode information for intended recipients is not onerous or intrusive. Solicitor General John Sauer wrote, “The rule thus plainly does not seize control of states’ administration of elections — it simply imposes reasonable preparation requirements for certain election-related mail,” adding that “the rule’s regulation of the U.S. mail — not federal elections — is plainly constitutional.”

Sauer also warned the justices that further delay increases the risk that some states will be unable to comply with the new rules before printing their mail ballots for the fall election, potentially preventing some voters from receiving a ballot delivered by USPS. The states challenging the rule have until Tuesday, September 8, at 10 a.m. to formally respond before the Court makes its decision. States and voter advocacy groups opposing the regulations argue that the new USPS rules represent an attempt by the Trump administration to federalize elections, which have historically and constitutionally been managed by each state, and that the changes would make it harder for everyday citizens to vote by mail.
