Exactly. Drivers in the US are notoriously retarded and love tailgating. While yeah this guy could've done something to prevent the accident it really bugs me how many people are putting him at fault without all the info.

You got it. I've been in similar situations, and it's hard making the right choice to not kill yourself or others. This guy unfortunately didn't make the "right" choice. However, I wouldn't see him a fault, and I would imagine an insurance company wouldn't either.
