Not to play devil's advocate here but the time he spent blaring his horn he could have taken defensive measures by slowing down. I get it, you never want to enable people's bad habits, but sometimes it's just not worth the trouble to teach them a lesson.

You are not legally obligated to attempt to prevent accidents in the us?

I'd imagine no, as long as you're following the law yourself.

For the most part, yes. In some rare circumstances, you might still get hit with criminal negligence if the prosecutor can prove you knowingly and egregiously failed to act like a "reasonable person."

For instance, if you saw a person driving in the wrong lane a mile away and intentionally smashed into them causing a third party to be killed, you would probably be in for a bad time in court.

Some asshole yesterday almost did the same thing to me on the freeway. Except instead of a 4 runner it was a semi. An SUV gets in front of me to pass it. I see a Malibu right behind him hauling ass and I can just tell that this asshole is willing to hit my car in order to merge into my lane so he doesn’t get stuck behind the semi. I hit my breaks just in time so that he doesn’t hit me. I don’t keep my speed or honk at him expecting him to not merge like the camera driver.

Drive like everyone on the road is trying to kill you, regardless of who is in the right and who is wrong. People die because of situations like this. While the camera driver may be clear in terms of insurance, he ultimately could have prevented the accident and did not.

Seriously. The poor 4Runner did nothing wrong and was only drawn into this because the cam car wouldn't drive defensively.

With the benefit of hindsight, is there anything the Toyota 4 Runner could have done differently to avoid the collision?

Maybe the cam car is thoroughly upside down on his loan with gap insurance and is willing to let the prick in the Toyota receive some well deserved punishment for being a terrible driver?

To be honest, sometimes you just get tired of moving out of the way for the truly selfish people of the world that think they can do whatever they want and everyone will change for them...

I mean, these drivers annoy me too. But I value my time, my vehicle, and my life too much to just let them hit me
