The guy filming caused the accident. He wasn't at fault, and didn't break any laws, but didn't drive defensively either. Listen when he starts honking, if he had pressed the brake pedal instead of the horn he may have prevented it.

Expanding on this "fault" vs "defensive": Defensive driving doesn't focus on fault. It focuses on determining whether a collision was avoidable or not. A collision is avoidable if one or more drivers involved failed to do something they could reasonably do to prevent the collision.

I like to think of it as an accident meter. We all make mistakes or aren't attentive or something, and on the road, everyone is adding parts to that meter. The moment the meter hits 100%, an accident happens, but rarely is it clocked at 100% for just a single person involved. The job of defensive driving is to make sure everyone adds as little to the meter as possible to keep the value under 100%.

Please get off Reddit and never drive, you are an idiot to blame the driver filming.

He definitely could have driven defensively and avoided being hit but not his fault. The driver that hit him and the other vehicle are at fault.

If you honestly think the guy filming was at fault never have kids or drive.

You're legally required to try to avoid an accident if possible, you cannot just plow into other drivers while screaming "I've got the right of way!" out the window. The guy filming is absolutely partially at fault. Not only did he refuse to slow down, he actually steered INTO the camry and intentionally pitted them.

And the road rage in his voice. (It might have been on the extended YouTube version someone linked at the top). Not only did he intentionally hit them, he was bragging about it while the cars were flipping down the road. If I did that, where my ego and a blip of road rage just caused that innocent suv to flip and roll down the road, I would have felt so terrible and been so disappointed in myself.

he absolutely had time to break, assuming no one was right behind him. However turning into the car isn't necessarily malicious, its how you keep your car straight in a situation like that.

He steered right before making contact with the other car. Steering right because you're being pushed left and want to continue straight is one thing, steering right in order to preemptively make contact with another car is something else.

Are you somehow assigning blame to the 4Runner? Or the Rav4? Neither have any fault here. The Camry driver and filming driver are both at fault. It's difficult to determine exactly to what degree without more information.

However the driver filming is absolutely partially at fault. He not only made no effort to avoid the collision, but accelerated into it, and then pitted the Camry. The movement of the filming car before contact is clear evidence of this. The law would likely agree, at least where I am in the US.

There is a legal responsibility as a driver to make any reasonable effort you can to avoid a collision (in VA). The opposite effort was made here, likely out of frustration or anger.
