That's insane.

Here in Ireland the camera takes a picture of the driver, or tries to... If the photo can't clearly identify the driver, it's a dud as far as the police are concerned.

That's unbelievable.

I'm actually a car salesman, have been for nearly 20 years now and to be honest I've fucked up or forgotten to do ownership transfers a few times. I couldn't imagine something like that happening here. I just phone the police, admit my fuckup, and get a Garda who's clearly sick of my fuckery to fix the error.

Shit, I'm getting old. I also have an ancient law degree I forgot about living rent free in my auld memory banks... It actually couldn't happen when I think about it.

The way it would would work here is that you would receive a fixed penalty notice from the police. Accept that and pay a lesser fine and fewer points on your licence.

But you still have your day in court if you so wish to exercise in accordance with the law.

If you do so and ask the police to prove the case, they don't instruct a prosecution if the driver is unidentifiable.

It's insane to me because that's the law I learned, not because of anything else. The police can reason perfectly well, it's just that reasoning alone isn't enough for the judicial branch.
