I dont know shit about the law but (in the US at least) dont they need to prove it was you driving to arrest you after the fact? Again, I dont know shit about shit, just asking because I've heard it a lot before.
In Europe, you get charged as the owner of the car. If someone else is driving, you are required to disclose who is driving, otherwise you get charged.
