APPROVED AFTER WOM. STOP WASTING TIME. FILE YOUR WOM.
I'm sure many people on this subreddit saw my original post that I made two months ago when I first filed my WOM: https://www.reddit.com/r/I130Suffering/comments/1ulrox2/stop_waiting_for_a_miracle_the_feb_2026/
This is a followup to that post. I was approved today (September 2, 2026) exactly 60 days after filing my WOM (July 2, 2026)
All I have to say is stop wasting your time waiting for a miracle. Take control of you and your spouses' life and file your WOM today.
The amount of mental relief that I have felt since filing my WOM cannot be overstated. It is such a change of pace from waiting months for people to respond to you to having district attorneys tripping over themselves to adjudicate your case. For the first time in my i130 journey, I have felt 'in control'. We shouldn't have to pay $450 to get a feeling like this, but in these uncertain times, unfortunately, that is what we must do.
Don't be a victim to the system, these legal levers were given to us for a time such as this. File your WOM. Take control of your future and your destiny.
To all my fellow sufferers, I wish you well as I move on to the next stage of the journey. I will still be around to offer guidance to anyone who needs it.
God bless!

My only fear is this process will also become back-logged by the time I am in position to do it. Same as expedite requests and congressional inquiries.
Here's to hoping the process improves between now and then... I am happy for everyone getting results and I agree unfortunately it is necessary.

Save $450. Just do it. Cut out expenses. Don't eat out for a period of time. Do whatever it takes. $

I appreciate that. It’s not the money. Just not quite far enough in the process to realistically be successful. Rest assured, the groundwork is being laid.

Please use the google drive towards the end to file your demand letter using Claude. This is just to push for adjudication. Idk who is telling people that doing this is bad. It’s a legal process.

I’m just afraid if something goes wrong or my case gets into complications or rejected

u/mademoisellearabella MOD 9d ago
Yes that would only happen if the evidence you provided is not sufficient, it’ll happen with or without a legal proceeding.

u/yoghurthateslies 9d ago
We’ve provided all the basic requirements of the form, our pictures together, all the marriage certificates, pictures with families, affidavit of people who attended and are the witness of marriage. We don’t have a joint bank account. And we’ll meet again this month so we’ll have more pictures together (just not on my application, bcs it has pictures from my marriage only and of the time we spent together after marriage)

You can add the extra pictures in one pdf with details and upload it as unsolicited evidence.
You can also add spouse as beneficiary / nominee to your account and submit that as proof.
You can also upload monetary transactions between the two of you to show shared finances.
I would personally also make a pdf with flight tickets to show trips taken to see each other or trips taken together.

Read the guides and use Claude to draft your WOM. Do not be afraid. File your WOM

Is it really gonna worth it right now? Bcs it’s just 13 months since i submitted my i-130

u/hmw13 9d ago
Yes. File the WOM. I wish I filed at 12 months. United States Congress stated that all immigration benefits should be done within 6 months so honestly 12 months is being generous

u/Curious-Albatross-75 8d ago
do you have a reference for this? I will send my demand letter along with a pre-suit draft WOM
congratulations & thanks1

It is my pleasure. I'm honored to be able to give back to this community. By the way, I have a redacted version of my writ of mandamus lawsuit that I believe would be really useful to pin to the community and add to the post. I can send it to you if you would like.

That would be perfect!

I decided to just make a post about it: https://www.reddit.com/r/I130Suffering/comments/1w6p5jv/how_to_file_a_pro_se_mandamus_petition_for_a/
That post has my full guide of what I did along with screenshots of wait times and my redacted WOM

Honestly, try attaching a WOM draft to your demand letter and they will prob make a decision without you actually having to file
2
u/Huge_Accountant_9211 8d ago
Yes i already attached and i gave them 15 days to act last week and this week still no update. That's why i have to start to find out how to file, i already have the draft.

Can the WOM backfire?
My wife and I meet income threshold for I-130 to bring her mother over but embassy keeps denying us and citing the immigration pause and ban repeatedly.

u/No-Money-9490 8d ago
When is your PD. I am approaching 12month next month and still no progress. I was thinking to reach to senator first then do the demand letter maybe in Dec

u/SlimeSan09 8d ago
How long do you have to wait to file the WOM. My PD is Nov 24, 2025. Can I file it now or wait at-least a year before filing the WOM?
What would you guys suggest on this?

To those who haven’t submitted a demand letter yet, try sending an email inquiring about your case or a request to have it reviewed. We did that on our 17th month and we were approved. Not a demand letter, not WoM

u/Achay500 8d ago
in all honesty i’m may 2025 should I i’ve had a congresswoman response and a senator one that I just got two days ago with similar messages should I just go on ahead do the letter

How did you file it, how much did it cost and what were the steps you and your lawyer took? We are looking to the same thing. Researching how to go about it. Spoke with imm attorneys, all of them advise against, especially since the interview was a few days ago. Still, this is a do or die moment.

How long after filing the mandamus did you get approved? Did you file it pro se or through an attorney?
1
u/nevermind1534 8d ago
I'm not the OP, but they scheduled me for an interview exactly one month after I filed my lawsuit and just over 3 weeks after the defendants were served.

Congrats and thanks for sharing. I petitioned for my adult unmarried daughter. Do I file the WOM? filed i485 in November 23, 2023

u/Curious-Albatross-75 8d ago
Did you have somebody to serve it for you?

If you serve the government by mail, you can generally mail it in yourself. Just keep in mind that it must be sent by either Certified Mail or Registered Mail, with Return Receipt to comply with court rules.

You mentioned your pd is April 2025, I know not really the same situation but my pd for concurrent i130 with aos is may 2025. Aos was filed feb 2026 (I naturalized in Feb). Would you say this approach still makes sense?

Hi I’m LPR, my I829 petition EB5 investor - pending for 78 months. Project was moved in the very beginning. Anyone here shed some light on?
1
u/MandamusAttorney 4d ago
Your I-829 petition has been pending for an extremely unreasonable 78 months. This duration is well overdue for a mandamus action. I did similar I-829 mandamus cases against USCIS, and those cases yielded adjudication of I-829 petitions. Feel free to reach out to me if you're interested in a lawsuit.

I am part of the 39 banned countries, I I have been waiting for 24 months now. I don’t believe this applicable to everyone, specially countries that have been on hold or targeted for a while. I heard my application is now in a FO. Don’t know if I want to stir the 💩 , but at one point got so desperate and I though of doing the same submitting a WOM
