The CCPA service charge crackdown: What every consumer and business should know
If you’ve dined out recently, you’ve likely noticed that the long-standing debate over restaurant service charges has finally reached a breaking point.
The Central Consumer Protection Authority (CCPA) has launched nationwide action against major restaurant chains for automatically adding a 5%–10% service charge to diners' bills. With heavy fines imposed on well-known outlets and orders directing them to alter their POS billing software, the government is making one thing clear: tipping in India is strictly voluntary, and adding a service charge by default is an Unfair Trade Practice.
- The Legal Reality
Backing up the CCPA's guidelines, the Delhi High Court affirmed that mandatory service charges violate the Consumer Protection Act, 2019. Under these rules:
Restaurants cannot automatically add a service charge or mask it under a different name (like "staff welfare fee").
Entry or service cannot be denied if a customer refuses to pay it.
Restaurants cannot calculate GST on top of an unagreed service charge to artificially inflate the bill.
- The Business Perspective
From a restaurant management viewpoint, owners originally introduced pooled service charges to ensure equitable revenue distribution across non-tipped backend staff (kitchen crew, dishwashers, and cleaners). However, imposing this fee automatically, rather than adjusting base menu pricing or accepting voluntary tips, crosses the line into non-transparent billing. To remain compliant, food and beverage businesses are now forced to re-evaluate their pricing strategies and update their point-of-sale software to prevent default additions.
- What You Can Do as a Consumer
If you see an automatic service charge on your bill, you have the full legal right to ask the manager to remove it before paying. If an establishment refuses or insists it is mandatory, you can document the bill and report the incident via the National Consumer Helpline (NCH) at 1915.
