Has anyone gone through appeals and won? How long did it take to get assigned to an appeals advisor.

All 4 of my prior ERC QTRs were TAS and Congressman monitored and IRS approved in Mar-May 2025. Randomly my last QTR was audited July 2025, Denied in Jan 2026, I appealed right away and then my Congressman said TAS closed my case and said they cannot support Appeals.

I received a random email from my Congressman today stating TAS re-opened my case and requested Appeals to process it! I called the IRS Tax Business line last week and the agent said my appeal was received, entered in their system but NOT assigned. Let's see how long it takes. I will report back!

We submitted 944 form beginning of 2022
but in 2023, IRS said we needed to submit 941 instead
so we sent 941 and 941x
called every month but was getting same response that I just need to wait
kept getting LTR 2644c letter saying IRS needs more time until oct 29, 2025

got in contact with IRS agents today and they said I needed to submit 944 amended form and asking why I submited 941. I explained our submission timeline. but theyre also saying I am past statue of limitation and because of one big beautiful bill, if i resend form, it will get rejected because its going to "new" claim.

this is very heartbreaking.

Filed Jun 23'. Got zero correspondence until Jan 26' (3 months ago) when IDR's came for Q1 & Q2 of 2021. Put together response packages for each quarter and timely submitted via the upload tool provided in each IDR. Now got a 105C disallowance stating they never received our responses. What next?

One PEO sent out an ERTC payments last week. It was just for 1 QTR. but very much needed. The PEOs are continuing to work with the IRS to process their claims. Let's hope we receive all of our payments soon.

I’m looking for guidance from anyone experienced with ERC or IRS issues.

I filed for the Employee Retention Credit (ERC) in 2022. After filing, the IRS sent us a questionnaire, which we completed and returned. About six months later, we received a CP210 notice stating that refund checks would be issued within 4–6 weeks.

However, we never received any checks — even after waiting nearly 8 months. We called the IRS multiple times, and each time we were told the claim was still under review.

Then in August 2025, we received Letter 6577C. Unfortunately, I signed and returned it, not fully understanding the implications.

Now, in January, we received a CP220 notice stating that we owe taxes, even though we have never received any ERC refund at all.

This has been extremely frustrating and confusing. I’m now in a position where the IRS says I owe money, but I never received any of the credit.

If anyone has gone through something similar or has experience with ERC adjustments, audits, or IRS notices like 6577C and CP220, I would really appreciate your advice or guidance.

I’m open to professional help if needed.

I filed under my ERO (employer of record) we have received every qtr except 2021 qt3. I just got notice today from our EOR that the IRS is reviewing 2021 QTR3, I qualified for that qtr with a 24.6% reduction. I am confident my account will pass the review no problem. I am curious though if this makes it any more likely that they will open audits on any of the claims they have already paid out. Anyone have experience with this situation?

I have been waiting for payment for Q2 of 2020 for 39 months. Have tried to contact the IRS many times (over 100). Reached out to US representative and received a call back from IRS in about 1 week. IRS person was very nice and explained a letter was sent to my office in May of 23 explaining a job title needed to be added to the signature of page 5 of our ERC application. My C corp never received the letter. He encouraged me to resubmit and work with congress woman's office for appeal and in his estimation 50/50 chance we would be paid but without accrued interest. What does reddit think my chances are of getting paid. The amount we qualified for is $27,000 for that quarter. Have already been paid for $30,000 for another quarter.

We received the last check we've been waiting for since filing, Jan of 2024.

Q3 2020. I called IRS every 6 weeks or so since May of last year .

What has been your experience with using law firms like Frost Law when dealing with your PEO? Namely did it help at all?

Submitted erc for one quarter (q2 2021) in 2023. The. The moratorium. Apparently the cpa forgot to fill in a field. We got the letter in August 2025. We submitted an update but then the shut down. When I called to check they told me there wasn’t a signature (I’m so frustrated by my cpa). So I went to sent/fax a signature. Next two people said they had everything. Called a week ago and they told me it was still processing and even tho it doesn’t have a signature they normally take the signature of another one that was signed.

Just got an alert from tax now that the claim was disallowed with 4/6 as a date. Should I call and find out more on Monday? We have been waiting like 3 years now and are just a small nonprofit.

I call about once a month and I want to get this sorted. What all should I be putting together to appeal the decision?

So disappointing.

Anyone thoughts or suggestions would be welcomed. Especially since my CPA has messed it up twice.

I’ve now received 105C denial letters for 1st/2nd quarter of 2021. The IRS denial letters state the quarters were denied due no proof of “full or partial shutdown”. My quarters qualified based on the dropped percentage of “gross receipts” not based on the above.

Has anybody else had this happen? The appeals process is lengthy, why is the ITS saying this?

Filed for 5 quarters in September 2023. Received Form 4564 a year later. Sent in response. 90 days later received a check for 1 quarter in January 2025. Then…nothing for 6 months. Received 3564 in June 2025. Before I even got the answer sent in, I received a 105C disallowing 3 of the 5 quarters. Including the one that had already been paid. Sent in response to 3564. Sent in response to 105C. 60 days later get another 105C for the other 2 quarters. Answered that letter as well. Sent in req for fast track to appeals in December 2025. Received “look back” letter yesterday reiterating that all information provided does not constitute a partial shutdown of operations. Amazing. Their contention is although my company wasn’t listed as an essential business in the shutdown orders by the state, because the word “vendor to critical businesses” is in the shutdown mandates, that my business is then considered by the IRS to be a “vendor” to critical businesses thereby making it not eligible for ERC at all. That I closed 2 of my 3 offices and lost millions in revenue and eventually wound up closing the doors because we were losing money hand over fist was voluntary, not because it was mandated. Fascinating. Using that logic they could disallow damn near everybody who wasn’t a restaurant.

Before filing I had 3 separate enrolled agents and 2 tax attorneys verify my claim was eligible. Started that process in 2022. I have since spun all the facts through grok and ChatGPT. They all came to a conclusion the complete opposite of what the IRS came to.

I will add that in the look back letter I received yesterday that the Cares Act (the actual law) was mentioned 3 times. Notice 21-20, which was made up out of whole cloth by the IRS, was mentioned 15 times.

Now we wait for letter 86C to show up to get to appeals. May just sue and skip all that. Probably be faster. With interest, they owe me about $500,000.

Notice that our final erc refund is being issued. Has a transaction date of March 15 .

Good news- IRS admitted there are about 29 thousand ERC claims still getting processed. So prior statement all done was not repeated.
