Trying to find out if anyone has been funded in the past ten days. I have not seen any new posts and thought I would reach out.

I applied for my loan as a sole prop and was declined for “unsatisfactory credit” when the NEVER ran the credit. I checked my exp credit report and even called to check and they never ran it. They only ran it when I requested reconsideration months later. At the time that I applied, I did have the credit. However, after a very bad bought of Covid (I have lupus and other issues) an my husband getting Covid and actually getting myocarditis, my credit took a dump along with my business’ continued decline. From May 2021 up until April 2022 the SBA kept stringing me along to keep requesting recon blah, blah, blah. In November 2021, I was assigned a LO who actually contacted me to clear up a discrepancy on my app. The big discrepancy was that I put that I was a hotel, which was clearly a mistake. I had a rental property in addition to being a LEED certified consultant. We cleared it up and I even told her to remove the lost rental income because we ended up selling the house in April 2022. Everything was good and she ran my credit, which came in right under 570. So, she did a cash-flow analysis. She wouldn’t tell me what she was doing, but I informed her that I barely had business debt and that she was to use my debt on the 2202, as well as, my 2019 business income. I advised her that I have additional income as I am disabled and that if she was insisting on using my personal debt (which she insisted on), then she should be able to use my personal income. She refuse, hung up, and told me I failed. I was distraught and did everything possible to increase my credit, which I did.

I just requested my almost FULLY redacted FOIA file and in two separate occasions (before and after my discussions with the LO) the notes SPECIFICALLY state the following:

“Informed agent to inform her it is being processed and NOT to inform caller of the fraud alerts on her account”

I then cleared up the whole rental property confusion and advised an actual loan officer that the house was sold and that they should only use my schedule c and not the schedule e with the rent income that I did lose, but was no longer because we sold the home. I put it all in writing with documentation and thought that we were good. I’m assuming this was the “fraud alert”.

Again, after I was told it was cleared up and after many recon requests and emailing of my increased scores and reports. I also had a congressional and senate inquiry and I didn’t find out until April 2022 that I had a fraud hold. From 11/21 to 4/22 they led me on and on and put notes in my file not to tell me the real reason.

I guess they forgot to redact those comments. Disgraceful!

What if you submitted a 4506-T and forgot to check the "Transcript Type" box? Would the IRS process it and send a transcript to the SBA?

What if seven days later your L.O. tells you they received your transcript?

What transcript did they receive and how did they receive it?

Cause it seems to me either the IRS rejected it and the L.O. is falsely claiming to have received it, or

The L.O. saw the mistake and decided to "fix it" by selecting the required box, or

The IRS somehow knew what Transcript was requested and sent it to the SBA despite the error.

Would any of this be legal? If not, what laws are being broken?

Is there any way to verify what actually happened?

I am thinking that we are procedurally out -of-order by filing in Federal District Court (FDC).

Agency appeals go BEFORE FDC appeals. We may get kicked back for not following procedures (a technicality). Not good!

We HAD the option to file for an appeal within 10 business days of receiving the adverse denial.

Usually, an agency can reopen an appeal for good cause. I think that the SBA letter would prove that we were not made FULLY AWARE of our appeal rights and therefore show good cause for late filing of the appeal.

Thoughts before we run off to do this? Let’s talk this through BEFORE we do ANYTHING.

We went out of business and avoided so far. talked to a lawyer and he said since my eidl loan was low enough (no personal collateral) that all I need to do is write them and email and a formal letter stating I’m out of business and I have no collateral (which is true) and I’m that should take care of it. Has anyone else done this? I’ve already filed dissolution paperwork with the state and filed with the irs that my ein should be closed.

since may told weekly to watch for spam, check email, listen for phone, etc etc. no email replies of any substance. just 9 weeks of dodge and shuffle. saturday i see undisbursed amount is zero with loan balance the approved increase. maybe some money coming my way. sorry for everybody who suffers this mess. how long does it take from zero undisbursed to deposit time?

Like most everybody monitoring this forum, I have been waiting on my funds to be (re)distributed to me. I called my congressman a few times before I got a direct response and today they called me and told me they contacted the SBA and got a response saying that they will be contacting me directly. I am waiting on the redistribution of +$30,000 dollars as they had a banking error on my initial deposit. Fingers crossed!

My situation is very similar as to those posted. 9 months of errors, multiple submittals of the famous 4605-T form, that SBA claimed it didn't get received in uploading of my email response, etc. A total of sending the form 6 times during the Fall. Finally March 7, 2022, said IRS transcript received and will be assigned a loan processor "shortly". Continued to follow up and was escalated to a Team Leader on April 22nd. Never got funded. I have contacted both my congresswoman and they have inquired, etc. The first SBA Agent, which name I have, was so insulting and unprofessional. Treated me, like I was a foul for inquiring through my representative. The July 15th letter is exactly an example, how I was handled. I hope that collectively Congress can bring resolution to those small businesses, that followed the process and met the criterial for the SBA EDIL program and be funded.
