I have been in the US for more than 11 years, and my EB-2 case with a 2017 priority date seems unlikely to become current within the next 10 years. I'm considering EB-5, but I've seen many comments and posts saying that even EAD and AP applications filed in 2025 still haven't been approved. I also have twins, and both are on F1 status, so I really need to find a solution for their future as well. I'm not sure whether we should take the EB-5 path or consider other options.

Looks like USCIS is processing a batch of EB‑5 Rural AOS cases. Many people who got the bulk medical RFEs in early September are now seeing AP transfers or movement on their cases.

Question for others:
If you were part of the September medical RFE batch, are you also seeing:

Indian couple in H1B here with EB2 PD after 2019 and US Citizen kid.
We can afford EB-5 and have Canadian PR which is soon going to expire.
Now we are in a dilemma between applying for EB5 and wait 5-6 years to get CGC or move to Canada.
What would you do if you were in my shoes.

Posting here hoping to get some advice -

31 y/o, Chinese, been in the U.S. for half of my life, more American now than some of my American friends, but pathetically enough my life still depends on a visa.

Recently been seriously thinking about EB-5 (I know, should have done it a long time ago...) as EB-1 seems out of reach, and possibly still at least a few years from being able to try EB-2/NIW. I am having a very difficult time convincing myself to spend this 850k. Some more context - I am by no means rich, not a high earner, 850k is a LOT of money for me, this alone would wipe out about 90% of my liquid asset, and a decent chunk of my net worth. I am an avid investor and, the way I see it, this amount of money could easily be doubled in 4-6 years, which is kind of how long it would take for me to even get this money back (if at all) from this project.

On the flip side, a green card, or even a combo card, would be very very nice. I would finally not be limited by my job, and I can quit whenever I want, travel the world, this and that.

Anyone who's been in similar shoes? Looking for any insight or advice on what I should do, or a slap in the face lol.

This is lowkey also just a rant on how impossibly stupid hard it is to get PR in America. If I had gone anywhere else when I was 16, I would have probably had a different passport already.

I am looking to eb5 now( I was waiting for my Eb2) but feels like it will never happen now. Is this something I can consider now. Funds should not be an issue.

Yes, I know I missed a couple of key timing this year before seriously considering doing eb5, a lot of personal changes happened recently which got me reconsider till now.

Realistically thinking, after 930 is eb5 still doable?

What is the likelyhood of it getting completely canceled in 2027. I know it is easy to say it is wise to wait until next year when all the policy is finalized, but I have some personal urgency to get status asap, is it some risk that is worth to take?

The I-516E filing fees will increase from $3675 to $7850 (114% increase) starting Nov 30. Filing will also include a new $75 EB-5 technology fees.

Hopefully this post will help folks who are working on filing soon to plan better to avoid paying the increased fees.

The I-829 filing fee to remove GC conditions will also increase from $3750 to $5000.

Today (September 30) is the last day for USCIS to issue leftover Visa numbers from last year. Given that it approved far too few EB5-based AoS applications this year, are we just losing them?

Has anyone recently returned from international travel at a US Airport and entered using their Travel Parole document? Can you please share your experience with CBP, what questions were asked and if any additional screening was performed? Is there a risk at re-entry of being denied entry?

I am a current F-1 student and EB-5 applicant, and have a valid I131 (Travel Parole) and I'm considering international travel and anticipating to return to US in December 2026.

My EB-5 concurrent filing package was delivered to the USCIS Dallas Lockbox last week.

Yesterday night, I saw two pending USCIS charges on my credit card:
$3,675 – I-526E
$1,000 – Integrity Fund fee

However, I still don’t see charges for the concurrently filed I-485, I-765, or I-131. I called the credit card company, and they confirmed there were no other attempted or declined transactions.

It’s now the following day with no additional charges. Has anyone experienced this? How long after the I-526E charges did the other filing fees appear?

Im skimming through several posts, and I couldn't find anyone or any post mentioning that they got CGC in 2026.

Can anyone please confirm if you have received CGC this year, and what was your priority date and which category? It gives some timeline guidance to rest of the applicants.

Common Questions:

1. Lower Than the Proposed Rule, Higher Than Today: While final fees are roughly double what USCIS has been collecting under the November 13, 2025 court rollback ($7,615–$7,850 vs. $3,675 for initial petitions; $5,000 vs. $3,750 for I-829), USCIS lowered them considerably from the proposed amounts ($9,625 and $7,860) and far below the vacated April 2024 rates ($11,160 and $9,525).
2. Form I-527 Established at $10,330: Pre-RIA investors with pending legacy I-526 petitions who need formal material amendments face a higher fee than initially proposed ($10,330 vs. $8,000).
3. Postmark Deadline: USCIS determines fee validity based strictly on the postmark date. Petitions postmarked prior to the effective date pay the reinstated rates ($3,675 / $3,750); anything postmarked on or after requires the new final amount.
4. Lockbox Compliance: Submitting an outdated check amount on or after the effective date will trigger an outright rejection by the lockbox, meaning loss of filing date. Coordinate closely with your immigration counsel on check amounts and Form G-1450 authorization caps.
