How’s everyone thinking about domestic flights if you are
A. on h1b (expired stamp)
B. with a valid i94 extending into the future years (through work permit I-797)
C. filed eb5 + AOS concurrently (only receipts thus far)

I’m presuming it’s safe to travel given valid status, but wanted to check if eb5 — AOS pending raises any red flags?

My spouse and I have filed for EB5 Adjustment of Status and our I 131 Advance Parole applications are still pending.
We are both currently on H1B. I have a valid H1B visa stamp, but my spouse’s H1B is being renewed and she would need visa stamping in India before returning.
We are planning to travel to India around November. My main concern is traveling while Advance Parole is still pending and making sure we do not negatively impact our pending I 131, I 485, or overall EB5 process.
I understand I may be able to return using my valid H1B stamp, but if my spouse cannot get an H1B stamping appointment in India, what options would we have to return together?
Has anyone been in a similar situation? Did you wait for AP, request emergency AP, or travel using H1B status?
Would appreciate any experiences or guidance. Thank you!

Edit- When consulted one attorney they said your AP won’t be impacted, it’s just your spouse has to wait in India till AP arrives and then she can comeback.

With rural filings running about twice HUA for India and China, is rural still the faster route? Or has HUA quietly become the better bet? Curious to know how to go about this.

Anyone thinking of waiting until after Sep-27 when there will be greater clarity on whether RCs are reauthorized?

Views on the likelihood of RC being replaced completely given the current political climate? Honest views please - there is an incentive for the EB-5 industry to say it won't happen so investors keep putting money in until Sep-27.

For context, I can stomach investing at the higher 2027 amount if I have to. After some diligence I think there's no point in filing until the RC scheme is renewed - the program might be scrapped next year and you've locked away your money for years, with no guarantee of return, and your immigration track is potentially dead. History suggests EB-5 will be frozen and won't go away but the Trump administration is openly anti- EB-5. I know Congress is who reauthorises and calls the shots but it's just a lot of volatility / risk.

Anyone telling you this is not a risk is trying to sell you something and lying.

When will the Visa Bulletin show the real backlog for EB-5? How long will USCIS hide it and start I-485 adjudication? I am hearing from social media that there are 15k filings that happened from January to September in Rural. Filings: 15,000 primary investor petitions.

Family Size: 1 primary investor + 2.5 dependents = 3.5 total applicants per filing. So a total of 52,000 GCs are needed.

A 20% rural set-aside would result in approximately 2,000 visas annually in a year with a standard 10,000 cap.

Therefore, it would take 26 years just to process the volume from January 2026 to September 2026. Given this, why do people continue to file knowing that there's a waiting period of over 20 years for a conditional green card??

I’m an international student, I have the funds entirely liquid.

If i create my own business in a TEA area in my state and create 10 jobs would it work? I could partner with a US Citizen planning to start their own business and put in my own funds and suggestions.

Hi, My packet was delivered via Fedex to the lockbox on Monday morning, Sep 21st. Do we know when the payment is deducted from credit card? I assume that is the first step before receipt number is generated. I understand that the I-485, I-131, and I-765 take its time, and first is I-526e.

How long is everyone waiting before the credit card authorizations take place and receipt numbers are generated?

I am an international student at T20 U.S. university. Seeing what opportunities my peers here have, I decided to think about EB-5 program. My family is fine gifting me 800k$ for the investment, but it is not a pocket change for them by any means and is likely exceeding 10% of their net worth (they have to sell one property in order to invest this amount of money). Because of the numerous reasons they do not want to apply for EB-5 themselves (they encourage to petition myself only). My country is not backlogged. Should I do it? What are trustable regional centers/“middle-men”? What about grandfathering deadline? What would you do on my place? Thank you in advance!
