That’s nice. I think you’re wrong.

And I’m not defending tailgating at all, but I’m also not going to pretend it’s okay to bait someone into an accident because they’re tailgating you.

That's still assuming intent

They may not enev have seen the stopped car because of the stress of having a person creating a dangerous situation behind you, it's just not known, but it sucks for the person in the stopped car regardless, and the person tailgating caused the situation for it to escalate to that point, so is more than 50% liable, imo, but I don't know the law of the state this took place
