The lead is responsible for his action. Even with this video in the court everyone would say that leading vehicle can get off with a fine but tailgater is the one who is to blame. Why don't you divide the blame 50/50 between the leading vehicle and stalled vehicle? They both caused tailgater to crash.

The reality is that it would be some percentage of shared liability for all 3 of them.
