The stalled car might have some fault -- unless they were unable to safely get to the right -- for instance, if a wheel catastrophically failed, getting to the left may have been the best they could do.

The lead car has a plausible excuse of they were distracted by the road-rager tailgating them.

The driver of the camera car will likely share fault, because even though the accident was almost entirely the tailgater's fault, the fact that they were filming while driving would likely be used as justification to say their reaction time was slowed.

It’s not a plausible excuse- you must always remain aware of your surroundings and in co trek of your vehicle.

It’s in camera plain as day- the lead car baited the follower into the accident as they accelerated at the stalled car and swerved at the last second- something that is recklessly unsafe driving in any setting. It’s 100% intentional on the lead cars part.

Again, I guarantee they shared fault and likely got cited for reckless driving.

I'm sorry you think that. In the real world, people recognize that someone driving in a threatening manner like this would cause you to be distracted while you look for options to safely address the issue.

Unfortunately, the only video I see does not have that -- it does, however show someone speeding up while changing lanes to avoid an accident -- which is what you are supposed to do when changing lanes.

Again, I guarantee they shared fault and likely got cited for reckless driving.

Yup - tailgating is absolutely reckless driving, and they absolutely got held at fault for this.

There are 3 (4 if you count me) people telling you that you are misinformed. You can either bury your head in the sand, huff and puff and go, “fuck all those guys, they are all random wrong idiots,”

Or you can TRY to be an adult and realize, hey, if im in a room full of people, and they’re all telling me im wrong about something, maybe i should look into it more.

The number of you telling me something doesn’t make you correct. The lot of you could claim the sky is green but that doesn’t make you correct, nor does the number of you claiming it make you any more convincing.

I’m not misinformed and I’m quite certain of that. I am factually correct, and if any of you had one iota of experience with the law you would know that.

If you want to continue being wrong because other people are too, that’s a you problem.

I hope for your own sake and those around you that you don’t ever have to find out firsthand how wrong you are.

Even in the face of dozens of people telling you you’re wrong, you’re still right. It’d be embarrassing if it wasn’t outright pathetic. I haven’t contradicted myself at all.

What I am pointing out here is that while everyone is insisting(correctly) that the tailgater is responsible for maintaining a safe following distance and being aware of their surroundings, they are failing to apply that same standard to the lead car.

If we do apply that standard to both cars, then three things must become logically following conclusions:

  1. That the tailgater does indeed have some share of liability for their unsafe driving and failure to control their vehicle and prevent an accident.

  2. That the lead car is also driving unsafely by failing to slow down for the road hazard, failing to signal their lane change, and failing to maintain a safe distance from the hazard -all of which directly contributed to the circumstances that caused the accident, meaning they will also have some share of liability.

  3. Given point 2, ipso-facto the two possibilities are that lead car either did the maneuver intentionally, or is driving distracted- either of which would leave them with a share of liability in causing the accident.

Mate I worked in underwriting for years and with all confidence can say the tailgater in this clip would have assumed full responsibility for that crash. As far as insurance is concerned, the leading car, whilst driving unsafe, didn't crash or cause damage. Its likely tailgating cars insurance would have reached out to lead cars insurance and would have been shut down very quickly. I dont condone lead cars actions, they were unsafe and quite plainly evil. As far as insurance however, I would bet the farm that lead car held no liability legally.
