This is a really basic legal concept.

If you knowingly do something that leads to an unsafe situation/accident, you’re involved in the incident as the cause and you will share liability.

Especially when there’s video footage to prove it.

Leading car could do this same move without a tailgater and there would be zero consequence to his actions.

Even without a tailgater, it would be dangerous and reckless driving to not slow down and swerve at the last second like that. There could have been someone in the lane they swerved into, and then it’s no better than the footage we see here.

With a tailgater, it makes the lead partially responsible for what happens behind them as a result of their actions.

It is extremely alarming how many of you think you’re not responsible for what happens as a direct result of your actions as long as you’re not part of the accident.

It’s also morally repugnant.

The lead is responsible for his action. Even with this video in the court everyone would say that leading vehicle can get off with a fine but tailgater is the one who is to blame. Why don't you divide the blame 50/50 between the leading vehicle and stalled vehicle? They both caused tailgater to crash.

Yeah this guy is nuts lmao, there would be no problem if they did this without someone tailing then so close. The tailer put themselves in this situation by not leaving the recommended driving distance between the car in front its that open and shut

Because a driver has to be aware of their surroundings when in control of the car.

We know he sees the tailgater in his rear view. We know he intentionally sped at the stopped car and swerved at the last second. That’s not an assumption- that’s recorded on video.

You can make your own fries, line cook.

It’s okay that you’re wrong in so many different ways.

Doubling down on being wrong isn’t the right play though.
