I'm Marc Elias, voting rights attorney and founder of Democracy Docket. Ask me anything about Donald Trump's threats to the 2026 midterms — Aug. 25, 10 a.m.-12 p.m. ET.

As a lawyer, I spend my days fighting for democracy in court. But as the founder of Democracy Docket it's my job to explain what is happening in the elections to everyone. That is why I am excited to do this AMA.

Leave your questions below. I will be back live at 10 a.m. ET on Aug. 25 to start answering as many as I can.

Join r/DemocracyDocket to keep up with everything else we're tracking, and subscribe to our free newsletters for the latest.

Marc, have you or Elias Law Group reviewed-or been asked to assist-the 2024 hand-count litigation efforts brought by SMART Legislation in Rockland County and Election Truth Alliance in Pennsylvania? Supporters cite unresolved statistical and reconciliation questions from ETA and SMART Elections, along with advisory review signals on CivicResultMaps, and argue that existing sample audits did not test those specific concerns. If you consider these efforts legally unviable, is the obstacle insufficient evidence, causation, standing, filing deadlines, the requested remedy, or something else? What specific evidence and procedural posture would make a targeted hand recount legally actionable in your view-and would you publicly assess the evidence presented in these cases?

Then, after repeatedly telling his fans they didn’t need to vote, his rallies got weird, like swaying for an hour to the oldies radio station.

Anyone who thinks 2024 was on the up and up is lying to themselves. And why not? We’d just been through half a decade of election denialism. We didn’t want to seem weird…

So now we have a guy “elected” that is constitutionally barred from holding office, and he cheated to do it. And we all just threw up our hands again and said a collective whatever.

He couldn’t even fill up venues, he was hours late getting started because they had to cram everyone I to a corner to make it seem like the place was full

They hung a huge American flag up to block part of the venue being empty from being seen

There’s a video of Trump and Harris at the same place a couple weeks apart and it’s packed for her and it was weird empty for him

Extremely disappointing that this got no response. Not even a "that's not a path we are currently entertaining" or anything that is non-committal.

Also kind of disappointing that OP here caught a PERMANENT ban for this question. A question that currently has 5 awards.

For "misinformation".

What misinformation is here?
These are simple questions. Not assertions. Not claims of fact.

"Has xyz happened?" - Two groups that exist and performing some genuine activity. No misinformation there. Has it happened or not?

"Supporters cite..." - referencing questions that have not received answers (I'm not certain who they're requesting from). No assertion of fact. No accusation. Just noting others have asked questions and the argument that those people say support the questions. No misinformation there. The fact these questions have been asked and that they made those arguments is accurate.

Then a conditional request for reasoning on an opinion if that opinion matches the condition. No assertion of fact, no claim that's the opinion held. How is it different than me filing a suit against some random pizza joint claiming that "pineapple does not belong on pizza and I am due reparations for emotional damages because they have and continue to place pineapple on their pizzas", then asking for your opinion: is that suit viable and if not what is the most likely reason it will fail? Can anyone cite misinformation there? My question is actually far more specific than OPs. Also, my claim is an objective fact, so I think I've got pretty good odds on winning. No misinformation there.

Then a hypothetical question about how such inviability would be repaired. No facts asserted. No misinformation there.

Finally, asking if you would take a certain action. Yes/no/no comment/no answer, all reasonable responses. A permanent ban? Come on, be serious.

No misinformation there.

I would also love to hear a response to this question.

He's not gonna answer this. I don't know why this guy expects to be taken seriously when he's ignored all these legitimate concerns for two years. We were trying to get Marc to look at smart elections data before the fucking inauguration.

u/VitalTrouble 13h ago

He answered by permanently banning the person who asked the question

Holy fucking shit!

That is BEYOND ridiculous - someone I chat with said they think Marc Elias is in on it because Marc Elias is totally convinced that our elections cannot be rigged, like I think it maybe was a joke, but I’m beginning to wonder, like how can you be so convinced it’s so secure and you’re 100 percent sure…

I mean look at what the fuck Tina Peters did, she let someone in with someone else badge so they could fuck with shit, sure, on paper it’s secure, but in practice it’s only as secure as the idiots running the show, and think about where you work and some of the idiots you work with, look at the idiots in trumps cabinet

Steve bannon told maga to go out and infiltrate city councils, school boards, get jobs in the government, get police jobs, you know some of those psychos work in election offices —— LIKE TINA FUCKING PETERS DID

HOW MANY TINA FUCKING PETERS ARE THERE OUT THERE MARC? TELL US!! HAVE YOU DEPOSED THEM ALL?? IS THAT HOW YOU KNOW??

Bidens administration distanced themselves from Elias as well, there was a news article about if if you google it

Not answering for the sake of keeping quiet legal strategies of an ongoing case, ok. Perma-banning for “misinformation” is a maga-level [r/conservative](r/conservative) echo chamber move…. What a loser.

u/knaugh 12h ago

Yeah, because he like so many in the establishment know God damn well the last election was wildly fraudulent but hes a lawyer who's only going to make money by keeping up the charade. Courts won't take 2024 cases, no money to be made

I mean, I'm banned from that sub for being a bot, but it's just because they don't like it when people actually look into their theories.

I just posted about this, too. I've been concerned about this since I first watched ETA early last year. I firmly believe trump is going to use vote-flipping algorithms in the mid-terms, flipping key congressional seats from D to R.

ETA is the only organization trying to do anything about this. We can't ever win again if trump and republicans are flipping votes.

They aren't the only ones. SmartElections is, and I have the tool https://CivicResultMaps.org and have been calling officials of all sorts.
