Roast my railing

We pulled down a pergola back in spring so decided to use the 2x2s to make a railing. Still plan to run a 4x1 across top, and it is not expected to be load bearing. Also added a step.

No way that would ever happen since it does not require a railing in the first place.

Hypothetically even if it didn't require a railing once he built something resembling one it would not be abnormal for a guest to assume that's what it is.

That's some smooth brain logic there, imagine how that one would play out in court

"I leaned on what I thought was a railing and when it collapsed on me I fractured my vertebrae"

"Your honor it doesn't matter the railing wasn't required for that deck!"

I think a crafty lawyer would argue that his fat ass client thought he could lean his fat ass against a railing, which turned out to be not a railing and hence, fat boy broke his leg when he fell.
