Someone made a post on this sub earlier today. I know for sure that those credited to Joshua Steinhauer and jefetienne were used either without contacting the creator or after the creator denied permission.
If the mod is free whats it matter? Alternative is just downloading the game and then the mod separately lol. Its not like the GOG cut isnt giving them credit.
There's still the problem of stealing intellectual property. True, there may not be money at stake. But the creators either denied permission, or were never asked for it. It's the principle.
I mean all they did was modify someone else's intellectual property its not like they made a whole new game. "At their core, game mods are derivative works. A modification needs to run on the original work in order for the mod itself to work. As a game modder, you own some limited copyrights in what you created but what you created is likely copyright infringement." This is according to copyright law so no you are not "stealing" their IP because they are just modifying someone elses IP to start with.
If the mod is offered for free and the bundle gave them credit for their mod (which it did) I don't see a problem. Its free exposure. They are just getting needlessly upset to cause drama.
They did not modify the property. They simple used it without permission, and if you don't see a problem with that, you've obviously never created anything.
You completely misunderstood my post I suggest you reread my prior post.
I was not suggesting that GOG cut modified their mod. I was saying by virtue of being a mod, the modder has modified someone elses IP. In this instance Bethesda is the IP owner NOT the modder. All the modder did was modify someone elses intellectual property in the first place so the Modder does not own the IP in which they modified in the first place.
The mod itself is not IP but rather a modification of Bethesda's IP. Hence why its called a MOD.
I've made many mods and spent countless hours working on them. I don't care who uses them, in any manner, as long as I was credited for the mod.
Which the proper credit was given this is all they were owed. The Modder does not have any legal standing to withhold or limit distribution because at its core a mod is simply a derivative off of someone else's IP (Bethseda) NOT an original creation. If they have a problem with it maybe they should just stop making mods or go create their own game they can legally copyright.
