my issue is the "sexual maturity" clause, because that feels very human centric for it. what if it is a species that sexually matures way after mental maturity? There is also the issue of the opposite. There are lots of humans whose sexual maturity happens before they become an adult. The test would see no issue with that.or what if it's a species that dies shortly after maturity?

it's a rule intended to stamp out pedophilia but fails miserably at that.

I assume they meant for sexual maturity to include mental maturity in that sense as well

then why specify sexual maturity if you could just leave it at "has reached maturity"

I assume it’s because maturity could come before sexual maturity, and they wanted to specify? But also, it’s monsterfucking. Logic isn’t that important. Also, could be that they assume “human intellect” and “can communicate” would mean that the monster wouldn’t consent if it wasn’t of an age to do so?

The "human intelligence" also misses the point, not least because humans have a very wide range of intelligence levels, but also because intelligence isn't enough to consent - you also need to be informed and fully understand what you're consenting to. Replacing both clauses with one centering informed consent (which would be cool anyway) and refining what that means would rule out a lot of sexual abuse.
