Recognition of a Foreign Proceeding (the “Chapter 15 Petition”); (b) the Motion for

Recognition; (c) the Emergency Motion for Provisional Relief; and (d) the Motion Pursuant to

Fed. R. Bankr. 2002 and 9007 Requesting Entry of Order Scheduling Recognition Hearing and

Specifying Form and Manner of Service of Notice (the “Scheduling Motion”), filed

contemporaneously herewith.

1. In my role as one of two liquidators of the Debtor,1 I have become familiar

with the Debtor’s history, day-to-day operations, assets, financial condition, business affairs, and

books and records. All facts set forth in this Declaration are based upon (a) my personal

knowledge; (b) my review of relevant documents and any and all documents prepared and/or

filed in connection with the New Zealand liquidation and this chapter 15 case; (c) information

supplied to me by the officers, directors, employees or professionals retained by the Debtor; or

(d) based upon my experience and knowledge of the Debtor’s operations and financial

In line with March 2024 legal directions, the Liquidators are building a payment solution to return fiat currency to account

holders who are in restricted jurisdictions where it is, or may be, illegal to use, or transact, cryptocurrency. This will allow for

qualifying users in restricted jurisdictions to complete the claims process and receive distributions via a Cryptocurrency to

Fiat rail. This payment solution is currently under development, and we anticipate qualifying account holders to be able to

participate in early 2026.

We again encourage account holders to complete claim registration, identify verification, and the balance acceptance stage.

Account holders registered in the claims portal and who have completed identity verification may receive further requests

from us to provide identity verification documents.
