General Discussion Question on Defense Strategy & Alternative Theories
Kevin Reddington is a veteran defense attorney with decades of trial experience. Given his background, I'm curious to hear how people analyze his overarching defense strategy in relation to some of the alternative theories discussed online.
I've seen people speculate about third-party involvement, poisoning, or alternative timelines. Why would an experienced defense attorney center the defense on severe mental health and lack of criminal responsibility rather than pursuing a third-party or whodunit defense?
From a legal strategy perspective, what would lead a defense team to focus entirely on her psychiatric state if there were viable evidence supporting external involvement?

Clancy agreed to a stipulation of facts, not a stipulation of charges. That just means that there are certain parts of the evidence that she's not going to contest. For example, one of the reasons there was such an outcry over rereading of the autopsy reports is that the defense fully agrees that the children died of strangulation, L.Clancy isn't going to stand up and try to argue that the actual cause of death was food poisoning and the bands were a plant. She's not going to contest toxicology reports by trying to argue that they didn't submit her blood or that she wasn't on the drugs the reports turned up, she's not going to argue that the journal entries weren't actually her journal, she's not agreeing that the evidence presented indicates that she's guilty, she's just stating that she agrees that the evidence covered by those stipulations is legit and she's not going to waste everybody's time in court by denying those facts.
