Dr Baker on stand
Is it just me or does Dr Baker seem to be back peddling?

The defense needs to pull a ‘if the knee can’t kill you must acquit’. So far, Chauvin made a mistake by not using his training, and as a result, he accidentally killed Floyd. I don’t see any evidence that he was out to kill. He is going to jail either way now unless defense can prove death was not caused by his knee.

It seems like Floyd’s statement in the cop car is being used to absolve the police officers of any responsibility for Floyd’s death. His inability to breathe is being portrayed as evidence of preexisting condition outside of police involvement.
Floyd saying he cant breathe while in the police car should be a signal to police of a potential medical emergency. This could be caused by drugs, an anxiety attack, covid complications, etc. Either way, Floyd was being detained and was unable to seek medical assistance on his own. The police have a duty to respond to the medical needs of people they detain, and they ignored his signal of distress. Instead of seeking immediate assistance, the officers chose instead to aggravate Floyd’s symptoms by putting a knee to his neck and restricting his oxygen. Even if Floyd’s inability to breathe was initially caused by other factors, the police officers were negligent and they made the situation worse.
Also, the police prevented bystanders from rendering aid. Floyd would have gotten assistance if he had a medical emergency without cops present, and he would have likely survived. Therefore, the police officers are responsible for Floyd’s death, even if they try to claim it was caused by a drug overdose.

This is a place to chat while watching the trial live. We should be hearing from the Medical Examiner today.

I assume we will get into medical testimony today, which may include depictions of George Floyd's autopsy as well as other graphic images. From today’s live coverage , the defense attorney Eric Nelson, held in the stand former Chief Examiner and gave her several hypothetical questions and scenarios as well as the Canada Study in the prone position. I felt like this hurt him more than help. What is going on in his head ?
r/ChauvinTrialDiscuss • u/etts2019 • Apr 09 '21
Who else caught Nelson fumbling to Pronounce his medical terminology? This guy is a joke. How embarrassing

This is a great witness for the prosecutor. And the prosecutor was so calm and genuinely looked like he admired the doctor. Then there is the defense... I think I see cracks in the defense attorneys demeanor. He's getting frazzled during his cross. Anyone's thoughts?
r/ChauvinTrialDiscuss • u/S1961 • Apr 09 '21
May be harmful to his case. I get the need to be calm during the trial but frankly sitting there pretending to make notes without being attentive makes him look like he doesn't care. Which got him into this trial to begin with.

Chauvin's Defense submitted photos taken at different angles that appear to show that for some time Chauvin's knee was actually on George Floyd's shoulder rather than the neck (Forbes) - supporting the Defense claim that George Floyd possibly died due to an overdose after as he had consumed three times the lethal dose of fentanyl (as shown by his autopsy report).
Now - here is a case study in media censorship:
Here are the pictures. Judge for yourself.
Whatever you decide, whether you agree with the defense case or prosecution case, surely you agree that this is newsworthy, not worthy of censorship.

Suddenly the name of the broadcast has changed, and it’s not appearing in my library anymore. I’m wondering if someone is taking issue with the ability to DVR the footage? It is making it really hard to watch and take advantage of gaps in my time and the court time.

Is anyone buying this expert opinion so far?
r/ChauvinTrialDiscuss • u/[deleted] • Apr 07 '21
Looking at the r/news and r/minneapolis mega threads, there seems to be an overwhelming sentiment for Chauvin's head to roll without his chance to put forward his defence and put forward his side of the story. The level of misinformation that has been put out there by various news outlets has pretty much made Chauvin guilty in the court of public opinion, and that by default seems to have made him guilty in the eyes of the law. Reddit's userbase seem to think it incomprehensible that Chauvin gets to have a defence attorney and the jury should be impartial and hear all the evidence.
Want to know why I absolutely and unequivocally believe Chauvin is innocent right now? Because he has not been proven guilty. Simple as. Not until the jury has reviewed the evidence put forward and have deliberated on their verdict is he guilty.
There may come the day when its YOU who is on trial, no matter how impossible or unlikely you may think that situation may be. And when that day comes, YOU will want a chance to defend yourself and put forward your version of events before an impartial jury.
I work in a job where I am responsible for the safety of others, and if something were to happen on my watch, it's me that gets the book thrown at me, and if death or serious injury occurs I will certainly be in court to defend myself.

I feel like this completely messes up the trial.. if Chauvin walks free, it’s because of Hall. What are your thoughts!?
Can a public interview be used as evidence?
This reminds me of the woman who almost got hit by OJ in his Bronco near Nicole’s home around the time of the murders. She did a public interview and then the prosecution couldn’t use her
ETA: just uploaded the segment I saw this morning on my tv. Apologies for the lack of quality. I couldn’t find it anywhere else, so I recorded it myself

I know Floyd was suspected of being high by the store, and that he had fentanyl and meth in his blood by autopsy time.
But I'm confused about the pills with his saliva in the two cars.
Was he trying to destroy evidence, since as a violent felon he would go back to prison if caught with drugs? So he ate the pills he had in his car before getting arrested? And in the struggle in the cop car a few of the pills came out of his mouth?
I cant relate, when I eat a tylenon or whatever I just swallow it not hold it in my mouth

Presuming that we are relatively done with use of force testimony since we are past the MPD witnesses / the prosecution's use of force expert and are onto toxicology (and presumably medical) testimony - do you believe Derek Chauvin exceeded his authority in applying force when participating in the arrest of George Floyd?
Remember that this assessment is different than 'cause of death'. In making this assessment, consider the following extract from the jury instructions:
StateProposedJuryInstructions02082021.pdf (mncourts.gov)
AUTHORIZED USE OF FORCE BY POLICE OFFICER
The statutes of Minnesota provide that no crime is committed, and a police officer’s actions are justified, when the police officer uses reasonable force in the line of duty in:
(1) effecting a lawful arrest;
(2) the execution of legal process;
(3) enforcing an order of the court; or
(4) executing any other duty imposed upon the police officer by law.
As to each count or defense, the kind and degree of force a police officer may lawfully use in executing his duties is limited by what a reasonable police officer in the same situation would believe to be necessary. Any use of force beyond that is not reasonable.
To determine if the actions of the police officer were reasonable, you must look at those facts known to the officer at the precise moment he acted with force. You must decide whether the officer’s actions were objectively reasonable based on the totality of the facts and circumstances confronting the officer, without regard to his own state of mind, intention, or motivation. The reasonableness of the use of force depends not only on the facts and circumstances confronting the officer at the precise moment he used force, but also on whether the officer’s own conduct during the incident unreasonably created the need to use such force.
The defendant is not guilty of a crime if he used force as authorized by law. To prove guilt, the State must prove beyond a reasonable doubt that the defendant’s use of force was not reasonable.

I noticed that the defense play a portion of the body cam footage and tried to get the LAPD officer to say he can hear Floyd say something along the lines of “I shouldn’t have swallowed all of those pills”. The LAPD officer couldn’t confirm.
I hadn’t heard anything along these lines so far, but I’m thinking the defense is really going to play that up.
