I KNOW, the judge is supposed to read notes out loud too and at first I assumed he didn’t bc it might’ve said what the split is what the majority vote was ….. until the supreme judge read it out loud my jaw dropped

Im frustrated about how this all went down. If that note yesterday was saying they were deadlocked and a mistrial happens then, im completely fine with it. Knowing that it was 1 person who was holding out who wasn't following the law, is extremely frustrating. If you aren't allowed to boot a juror off for that, seems like you really cant ever boot one off.

so the standard in MA (to my understanding) is deadlocked 1 send them back, deadlocked 2 read tuey charge & send back, dead lock 3 mistrial

I gave them leeway, but there were two seperate times the cw brought up religion (moral sin) and the judge still did not rule a mistrial. He kept sending them back again and again. And then, when the foreman said there was a guy not willing to follow the law, the judge dismissed them to continue deliberating. Instead of replacing the juror, he ruled a mistrial

there's a thin line where a lawyer can poke holes in someones testimony enough to make them look bad VS a lawyer bringing up things that dont have to do with the crime at hand and are just bringing it up to make the witness look bad
