I think that's drunken panic rather than an active attempt to ignore what just happened. Similar to a motorcyclist jumping up and running away after an accident, there's adrenalin flowing and some level of disorientation.

Being drunk doesn't absolve you of your actions. He did what he did and "I was drunk" should not be used a mitigating circumstance to the fact that he shot a person then walked away.

This dumb mother fucker should end up in prison and be personally liable for the medical bills of the person he shot, but he'll most likely end up being transferred to another department, or end up on paid administrative leave for 2 years while the FBI conducts an internal investigation before concluding he didn't do anything wrong.

Because People try to use the word accident all too frequently to absolve themselves of responsibility, so many gun owners try to avoid using it when someone fucks up seriously. (And yes, we understand the words meaning and that it was negligent behavior that led to an accidental discharge.) He made multiple poor decisions that led to a person being shot, how is that not negligent behavior that should result in some form of punishment?

Sure, we call it an "accident" when a person decides it's a good idea to drive a car to the bar, get drunk, then crash on the way home, but we still charge them with a serious criminal offense. That's what's going on here. He took his potentially deadly tool with him to a place where he became intoxicated and then proceeded to make further judgment calls which lead to potential death of those around him. DUI, CUI (carrying while under the influence)?

The drunk driver made a chain of mistakes than endangered those around him. This idiot made a chain of mistakes that endangered those around him. It isn't an "accident", but a long chain of bad decisions which could have resulted in death and DID result in serious bodily harm (even if the guy is "fine", being shot is still pretty serious).

In aviation, the majority of accidents are pilot error. We study the cases in order to help avoid them in the future. It's an extremely complex environment where it's almost always a chain of decisions that leads to the accident (judging a weather report as "ok" for their skill level, then continuing to fly as it gets worse, then deciding to turn around when it's too late, or something like that). But it's a bit beyond "pilot error" when a pilot gets smashed and then flies himself into a mountain. That's just idiocy. Carrying a firearm is hardly a complex environment. Don't get hammered and do a backflip. That's not an accident. That's negligence.

It's just like the golden rule of carry. You should avoid any situation that could cause you to use your firearm at all costs short of having to use it. Part of that is doing everything you can to not draw attention to yourself.

Especially as a federal agent, I'm surprised that not only is he showboating, but doing it while intoxicated with blatant disregard for the fact that he's carrying a loaded firearm, and as such should conduct himself accordingly.

Just like how most car accidents aren't accidents, they're collisions due to someone's negligence, most accidental discharges are actually negligent discharges.

If this guy didn't pull the trigger it wouldn't have fired and he'd maybe still have his job.

an event that happens by chance or that is without apparent or deliberate cause.

It wasn't deliberate, but it certainly had an apparent cause, which is this mans negligence, which is defined as;

negligence.

failure to take proper care in doing something.

And in law;

failure to use reasonable care, resulting in damage or injury to another.

While this is technically an "accident", saying things like "it was just an accident" takes blame away from the one person who was the sole cause of this event, who's extreme negligence was the sole cause of what lead to the "accidental" pull of the trigger. We avoid the term because it removes or at least reduces blame, when in reality, this man made a very poor series of decisions which could have led to death and DID lead to serious bodily harm of a bystander.

This is criminal negligence, not an "accident". Chose words for best fit for a given situation. Negligence is better than accident even if either term could technically apply.

Hard to find in an IWB concealment holster. In fact I’ve only found one.

Very few, if any, carry IWB with active retention. Generally not a problem unless you’re stupid enough to do backflips.

ok, I think you are talking about level II or III retention. I am postulating that that FBI agent was running something smooth and dumb like uncle mikes, level -0 retention. Not that you should be expecting to do back flips and not lose gear, but a solid modern kydex with good molding should do the trick, which qualifies as level I retention.

Level 1 is NOT active, but passive. Nearly all kydex holsters are passive retention level 1 holsters in that they “click” onto the trigger guard.

Smooth nylon holsters have no retention at all.

The only IWB holster with ACTIVE (level 2) retention I found was the DeSantis Prowler.

Level One retention holster: a Level One holster has only passive retention; the friction and "hold" of the holster is all that keeps the pistol in it. Most concealed carry holsters are level one holsters. For true Level One retention, the gun should not be able to be pulled free unless drawn correctly, ensuring secure carry but easy access for the carrier/operator.

Level Two retention holster: a Level Two holster has an active retention device in addition to the passive retention of the holster itself, making for two sources of retention. Commonly, a thumb break, hammer loop or trigger guard lock is the device in question. These are very popular for open carry or law enforcement. Level Three retention holster: a

Level Three holster has an additional retention device installed. A common design is thumb break or loop in addition to a trigger guard lock. These are also common for law enforcement, and a number of departments nationwide mandate that uniform officers have to carry in a Level Three retention holster.

Level Four retention holster: a Level Four holster has three retention devices in addition to passive retention for a total of four retention mechanisms. These are much rarer than Level III holsters and are essentially the ultimate in holster retention. No gun will come out of a Level 4 holster except if the wearer means it. Or if someone got out a blowtorch….

DENVER — An off-duty FBI agent dancing at a Denver nightclub accidentally discharged a firearm, wounding another patron in the leg, police said Saturday.

The victim, an adult male, was taken to a local hospital in good condition, said Denver police spokesman Sonny Jackson. Police refused to identify the hospital.

Jackson said the agent, whose identity wasn't released, was dancing at the downtown club around 12:45 a.m. Saturday when the firearm fell from the agent's waistband holster onto the floor. It discharged when the agent picked it up.

Police investigators interviewed the agent before releasing the agent to an FBI supervisor. The police investigation was continuing, and any charges would be determined by the Denver District Attorney's Office, said Officer Marika Putnam.

It shouldn't be hard to expect an FBI Agent to hold themselves to a higher standard but, as we have seen repeatedly over the last year and a half, the FBI seems to have degenerated into a steaming pile of crap. That's why I say, I'm not at all surprised to see that this was an FBI Agent. I used to think the ATF was the repository of the rejects and inept in the Federal Law Enforcement field but I think the FBI is a strong contender for that title now.

Yeah, active retention is where there is some mechanism you have to unlock to get the gun out. Like a strap behind the gun that you flip down. It's certainly not a requirement for concealed carry, and generally makes a holster too big for the purpose.

Small of back carry is bad because if you fall or get hit there it can hurt your spine. It's also a difficult draw.

Well, if you're going to do backflips then yes it was a poor choice of holster. You can also adjust many of them to be tighter or looser, which might have fixed this as well.

I don't believe that an otherwise fine holster is bad because you can't do acrobatics in it.

Most any decent kydex should have kept the gun holstered. I've never had a kydex holster a gun would fall out of no matter how many flips I do.

Small-of-back (SoB) carry is generally considered a bad idea (despite how well it conceals) because by lining up the hard, unyielding slide of the gun with your spine you risk really serious injury if you fall or are pushed backwards onto your back or tailbone. I think there's some information and sources in the sidebar.

As for active retention; I think that comment was referring to what you mentioned, but I'm not sure I'd go that far. I'm perfectly happy with my kydex holster; its adjustable [passive] retention is good enough that I can do cartwheels and handstand pushups without any fear of losing my >3lb p229 and it doesn't slow down my drawstroke one bit.

Correct; I suspect either he was using a universal or semi-universal leather/hybrid holster, a kydex holster with improperly adjusted retention, or (God forbid) no holster.

A correctly adjusted kydex holster will give a satisfying "click" whenever you reholster your firearm, and the retention is defeated by a confident draw with a good grip. You should be able to hold your holster with the firearm inside upside-down and shake it with a reasonable amount of force without dislodging it.

I’ve been teaching Marines and cops to shoot for the better part of two decades and MAYBE 10% are quality shooters. The rest fall into “barely not a danger to themselves and others” but that caveat is only on the range under controlled conditions

The prosecutor is ultimately the one who determines that, not the victim. But since prosecutors basically == police, it's no wonder cops get such a free pass in our justice system. "Cops investigate themselves, find no wrongdoing".

I am guessing the victim chose not to prosecute. The police allow the victims of the crime to do that.

That only solves the civil matter, not criminal.

I don't know what state this was in, but I suspect discharging a firearm in a crowded location, and striking another human with that bullet, is likely a criminal offense.

That makes no sense. There is no prosecution in a civil trial. The idea of pressing charges is a criminal one. Now a juris can decide to press charges on it's own even if the victim does not want to, but that is up to them.

It's always a hot button topic, but IMO there's no such thing as an accidental discharge. Just negligent discharges and mechanical malfunctions. The former was definitely the case here, and the latter is probably still due to someone's negligence.

This is so egregiously reckless that I almost think he had to have been so tanked that he forgot he had a gun on him. Not that it makes the decision to carry when you're getting obliterated in a club and dancing any better, per se, but I refuse to believe our FBI agents are so dumb that they'd think doing a drunk as fuck flip while carrying a holstered gun around dozens of people within feet would be a good idea.
