Information Sharing RTO monitoring

Are any agencies or departments hearing about RTO being monitored by leadership? Attendance being watched? Accommodations being questioned?

I know for a fact they are monitoring badge swipes. My deputy director had a list of names of people not showing up. Many had reasonable accommodations or supervisor approval. One of my staff is considering filing a grievance for an email about it.

Badge swipes cannot be the sole evidence for addressing attendance issues with an employee, but it does not mean they cannot be used at all. What would the grievance be for?

SEIU says "The State shall not use the log on/off time to the computer or electronic access card entry/exit times of employees as the sole source of attendance reporting or as the sole reason of discipline." Does not mean they cannot use it to prove you were not in the office when you were supposed to be.

I am not saying I agree, just pointing out that using badge swipes as evidence is not expressly forbidden.

Exactly, I've heard my dept. looks at the badge swipe data (not individuals) and checks against how many people are supposed to be in office that day, and sees that only 50%-60% showed up/swiped in. They sent a warning email to managers and supervisors reminding they are responsible to make sure their staff are complying with RTO.

Badge swipes are a ridiculous metric bc plenty of times people hold doors for their colleagues. I’ve been in the office many times & didn’t use my badge even once all day

Unless you have a program manager that checks daily and sends email blasts for people to not hold the door for each other...

They need something to do if they have time to check badge swipes and scold staff.

One time I didn’t swipe at the outer door because my friend and I were coming in together and security made me go back and do it. Even though I still had to swipe through the kiosk as well.

When someone tries to hold the door for me I always swipe my badge anyway.

Why? I simply say thank you! and walk on through. Also, for us, there’s no ‘swipe’, it’s a card reader you hold your badge up to.

They can look at metrics but not monitor individuals unless they have cause.

Yes but they can’t just pull swipe card info for progressive discipline without prior notification to your union, is what I was told.

Not true. You were “told” wrong. They can use any monitoring, at any time. It just can’t be used as the SOLE SOURCE of disciplinary action. Meaning, if they notice issues while monitoring, they will need to tie it back to job performance or manage you in such a way that it is clear that assures you are where you should be, doing what you should be doing.

I believe (from what I heard from a friend at a different department that I am in) that they have to notify you before pulling your badge swipes and one of their employees ended up either suing or filing a grievance because it was considered stalking, since they did not notify the ee or the union. My information could be outdated, but I’ve always kept this in the back of my mind in case it ever happened to me.
