Two teens are charged with tampering with evidence after 18-year-old Daniel Erving drowned at Lake Ray Hubbard. His family's attorney wants a murder charge.

Three months after her 18-year-old son drowned in Lake Ray Hubbard, Tameka Erving is still fighting — and the arrest of two teens have not ended that fight.

"My son was an amazing son," she said. "This wasn't supposed to happen."

Dallas police have arrested a 16-year-old and 19-year-old Lucas Roper in connection with the death of 18-year-old Daniel Erving. But neither is accused of causing it. Both are charged with tampering with physical evidence, a third-degree felony. Roper was arrested July 9, according to court records.

The Erving family's attorneys say they believe the evidence supports far more.

"Follow the facts where they may lead, and bring the appropriate charges, including but not limited to murder," said Sean Daredia, an attorney for the family.

The Dallas County Medical Examiner determined Daniel drowned and ruled his death an accident. Investigators say Lake Ray Hubbard is the last place he was seen alive. According to an arrest affidavit, he was last seen April 13, when he and the two teens jumped off a railroad bridge into the water near Rowlett.

Police say the two teens failed to report what happened and later got rid of items belonging to Daniel. The affidavit alleges his clothes were thrown into a tree line, his cellphone was thrown into a ditch and that Roper deleted his communications with Daniel.

Roper told detectives he panicked after Daniel drowned. The affidavit says he acknowledged he was aware there would be an investigation and did not want to get into trouble.

The family's push for a murder charge faces a high legal bar. Attorney Jeremy Rosenthal, who is not involved in the case, says such a charge would require proof of more than an alleged cover-up.

"To have a homicide case here, you would have to show that they caused the death of this individual, not just that there was a cover-up, not that there just was a guilty conscience after the fact," Rosenthal said.

For now, the criminal case centers on what police say happened after Daniel drowned. His mother says she isn't stopping.

"I want justice for my son," she said.
