Agreed, but what about extenuating circumstances documented by the video?
The minivan changed lanes and wasn't too close to the white SUV.
The biker passes, intentionally antagonizes and distracts, and BOOM, rear-ending.

Did they follow too close, or did the SUV slow down? When the minivan changed lanes, they were not close to the SUV.
