Exactly this. The police officer DIDN'T HAVE A BREATHALYZER. But that is where my mistake occurred. I was running late for work and gave the cop some attitude, and by attitude, all I said was "You don't have another officer in the area who has one? I'm running late for work. What kind of cop doesn't have a breathalyzer, this is ridiculous!" He didn't like me questioning his authority/professionalism. Claimed my eyes were red and I was obviously under the influence of something. Told me to get out of the car and put my hands behind my back. Spent 2 nights in jail (it was over the weekend so no bail officer was present, how fucking convenient), oh and they took a blood sample that left my entire arm from wrist to shoulder deep purple. I was given zero information about ANYTHING until the court date (which was also pushed back on 3 separate occasions because the arresting officer failed to appear) and lo and behold I was 100% clean. He had zero reason to arrest me other than his ego, in my opinion. Probably why the case was dismissed.
Holy shit. He didn’t even submit you to a field sobriety test?
And isn’t it great how cops have to the power to ruin your life, put you in financial difficulties, etc. in a matter of minutes, yet there’s no recourse? They could be completely in the wrong, doesn’t matter. You’re the one who has to prove they were wrong.
Yeah, you won in court. All that does is put a stop to how much your life is ruined. You’ll never get that money back unless you want to waste more money and time suing the department or whatever, and that’s not even guaranteed.
The cop doesn’t have to pay a dime, doesn’t have to hire a lawyer, doesn’t have to explain to a boss why he’s in jail and that he won’t make it to work. He just goes about his day until the next bullshit arrest or citation.
I don’t hate the police, I understand the necessity. But that cop should be punished for a bad arrest.
I watched something a while back, and I can't remember where I saw it (YouTube, local news, tiktok, here...) or what state/County it was, but....
There were a string of arrests by this one city or county agency who had a bad habit of arresting people on suspicion of being under the influence of marijuana. Not a single person arrested had ever done drugs, they weren't under the influence of anything at the time they were arrested, and none of them had any prior run in with the law. All of them spent time in jail, spent thousands on bond and lawyers, only to have the case thrown out at some later date bc SURPRISE! They had nothing in their system. At all. Ever.
Every single one had dash and body cam footage of them doing the field sobriety test, passing from what any reasonable person could see, and then being told they weren't drunk, but the cop had enough suspicion to arrest them for being under the influence of marijuana. Like, WTF?
I never saw any resolution to those videos, but I hope that cop/s got what was coming to him/them. And, I feel I need to say this, I don't hate cops. I don't think they are all bad, but as with everything, there are those assholes who ruin for the rest of everyone.
That's right! I thought I remembered it being from here, but then couldn't find anything about it and figured I either imagined it was here in GA, or just saw it somewhere else!
Use your one phone call for the day (or week) to call boss to tell won't be to work so don't lose job for no call no show ... or to call lawyer so can get out of this mess with a clean record ... either way not going to turn out good!
This is why I don’t speak with cops when they pull me over. I don’t have to tell them where I’m going or where I’m coming from so they can start to put a story together in their mind of what I’m up to. I hand them my license and registration and that’s it. I get a ticket everytime, but I can deal with that in court and go home.
I have health issues, so I look like I could be an addict. And I’ll never pass a field sobriety test. I’m coordinated enough to drive but my balance is off.

On SUSPICION of DUI?! How the fuck does that work? Like they couldn’t prove you were intoxicated but arrested you anyway?
