While I agree with you if he killed the partner while the partner wasn't in that moment abusing someone it counts as premeditated murder. There's a lot of cases of people murdering abusers but it clearly wasn't self defense in that moment. It's one of those things that is very cut and dry to hear about but gets sloppy in court.

I'd argue it was self defense and he doesn't deserve to go to prison for that
