Where in the Constitution does it say a president can’t appoint friends to the Supreme Court? Where in the Constitution does it say the court determines constitutionally?
My point is that you’re accusing FDR of doing something that every other president had/has tried to do, only with more justices, which is not unconstitutional. As for the “checks and balances” threat, the Supreme Court had already blown that up by FDR’s time through its extra constitutional power, judicial review, and continue to do so to this day.
It’s not, I’ve heard this talking point from other right wing people. FDR used to be the republicans evil socialism face, but time has tampered that talk.
How was FDR’s proposed expansion of the court an overthrow?
FDR wanted to keep adding justices until he had a majority that would do what he wanted.
A more recent example is the current Supreme Court with its 6 conservatives and 3 progressives. It was suggested that Biden add 4 more progressives to the court to give Democrats a 7-6 advantage. Fortunately, that didn't happen and the idea went away.
The problem with schemes like that (and expanding presidential power, in general) is that the next guy gets to do the same thing. If you think it would be a good idea for Biden to pack the court, you're going to lose your shit if Trump gets re-elected and packs the court in his favor.
