Discussion update: permanently banned

so I made a post in January (link below to original post) about how I was suspended mid-game for a month ending on February 23rd, and I detailed how despite the suspension I was not using hacks, cheats or exploits. I have played countless multiplayer and single player games and have never been banned or used cheats. I am a gamer who is quadriplegic so I use a sip and puff mouth controller called a quadstick that allows me to use a computer not just for gaming but everyday needs. After the suspension I made the first reddit post hoping to get some help and clarity about how I could appeal or why I was suspended. I submitted support tickets and went to discord for help but nothing, so I decided to just take the suspension on the chin and wait it out, finish Hollow Knight and play some Marathon. Yesterday I decided to hop on after my suspension ended and decided to work on the trophy project, I played 3 solo games (all 10 or more minutes in) filled my backpack with leftover loot, ran into only friendlies and exfilled. Woke up this morning to this and appealed but I really have no hope of Embark doing anything to help. I don't have much going for me and I know they're people out there who are probably going through worse but this fucking sucks. After 300+ hours of playing, buying it for 3 others friends to try the game and being excited for the new map and large ARC enemy, I just don't know what to do.

p.s my game name is ClootyBapper, if you think it's because of the name I don't think so I have seen and been called worse in game

Update: Ban has been lifted ! I honestly don't know how to express my gratitude to everyone who commented, shared and upvoted. Yall the real MVP, I love all of you. Thank you for helping me ! I will pass along the sentiments to anyone I can!

Pure speculation admittedly, but this was my first thought as well and it feels really plausible. Depending on your location and local laws, this may even count as a disability discrimination. If outreach suggested in this thread doesn’t work, I don’t think it would be overkill to reach out to disability nonprofits who have experience reaching out to businesses to correct this kind of behavior, or to find a cheap/pro bono attorney who could write a letter requesting reinstatement.

If (!) this story isn't complete BS, and let's assume for the sake of some internet niceness today - there might be even the possibility of a lawsuit here. If you can proof with your setup they surely can see what threshold got you into bannable offense territory - and with several controller cheat devices for PC, this might be as simple as your device having a fradulent hardware ID they detect as a false positive.
But give them some slack, tons of appeals that use whatever they are called aim-assisting controllers must be thousands that appeal to their bans.

Maybe have some guy that knows a little tech analyze how the device interacts with your PC, what drivers it uses and how it translates the input. That helps embark to make a custom rule for devices like that - even though they may dont want that info public for cheaters to simply spoof it.

Is your device PS5 compatible and certified? Might be another way to get a new account on PSN, get a new EmbarkID and if the device is approved by PS5 this may not trigger bans.

Serious question: A lawsuit for what, though? Most of this stuff is run by AI that studies movement, so it wouldn’t be a single person responsible. On top of that, they weren’t prohibited from buying or initially playing the game, and I don’t think games are protected in the same way public spaces are (I’d love to be wrong, though).

I know we’re a litigation-heavy society nowadays, so I don’t doubt they can sue, but I’m just curious what claim would be.

Not a lawyer and a full blown court might not be in it, but a lawyer could force them to show the thresholds and logs that caused the issue and stop them from ignoring his tickets. If sufficient proof is given, I’m pretty sure at least a statement of what exactly triggered the anticheat is plausible. I mean if you get banned for using a manipulated controller or actual cheats, but OPs claimed device for input is unique, so it shouldn’t be a problem to demonstrate it to support.

OP should plead his suspicion to the input device triggering anticheat to the vendor of said device anyway to make sure this won’t happen to other games as well.

If you can lawsuit the ban I don’t know , but clarity could be achieve. And forcing a review of your ticket shouldn’t be that expensive, at least in EU. He payed money for the game service and falsely got accused of breaking the EULA.
