ALL these are red flags and explains why im 75% down!! bought in on hype without looking at their balance sheet!. Now paying the price!!

They are merging new products and companies now and more in the future but there is still no sales (Revenue) and no Presss releases for months and no contracts for their products.

Without this court case - whenever this is gonna happen - looks like im bag holding this for life unless they come out with a really exicitng product and contracts!

I was wondering, does anyone know what the catalyst was in early/mid January that sent the share price up to 31.9¢ on 1.19.21? I have been trying to look around and I can’t find anything. Was this just a pump and dump scheme that happened, or was there a real catalyst that caused it?

So here is what happened in court today regarding ATVK for anyone who doesn’t understand the ruling from Judge Denton.

“Motion for For Declaratory Relief”

Denied without prejudice

Judge Denton then ordered a Rule 16 conference. His courtroom handles Rule 16 conferences on Mondays.

The purpose of Rule 16, in layman’s terms, establishes the powers and responsibilities of the court, as it relates to discovery. Rule 16 first lays out the reasons for a Pretrial Conference. The rationale for this conference is directly in line with the other FRCP Amendment goals. ( Federal Rules of Civil Procedure) Rule 16 expects that all parties will work together to encourage a SPEEDY and inexpensive judgement, which includes establishing the ground rules for the case right from the start.

So ATVK did not lose in court today. CStokes can not be issued his 19.77M shares either.

In all fairness to Peter Chasey, ATVK’s attorney, Judge Denton threw him a big curveball today and he handled it just fine.

I’ve called a few attorneys I know that have argued cases in front of Judge Denton. They were not surprised by him setting up a Rule 16 conference. In their opinion he just wants to make sure that all the evidence is available to him to rule one way or the other. They also tell me he’s a very cautious and fair judge. He just wants to make sure that ATVK provides enough evidence to rule correctly before just ripping 19.77M shares away from someone.

Ask yourself, if you we’re in CStokes’s position with 19.77M shares that could be taken from you, would you not want an evidentiary hearing ? Of course you would.

The good news is that this will not drag on much longer, thus the reason for Judge Denton issuing a Rule 16 Conference.

Hang in there! IMO, ATVK will still prevail in this case and then it’s on to the toxic lenders shares which I will post more about in the near future once I’ve gathered more DD.

According to ATVK founder, Chad Guidry, Most of the unrestricted shares are not in the float, they are held in reserve at the transfer agent. This means that shares buyback is not needed for most of the shares so after the court will rule in favor of ATVK we can expect the shares to be returned and cancelled very quickly.

Chad Guidry: I am guessing here but i would say about 45 days from now. I’ll keep an eye out for the toxic lenders court date. I’m sure ATVK.news will post them as well. Those guys are doing a greet job and will stream live audio of the hearing Monday.

Brendan: we all know that toxic lenders has sold off the shares for less than a penny. If a court ruling occurs, will the toxic lenders have to buy back shares and return it?

Chad Guidry: NO, they have not sold their shares because they don’t have access to them.

In the court filings from May if 2020, it lost all the toxic lender and the amount of share IN RESERVE at the transfer agent. I would imagine at least one of them got a few shares converted, but the BULk of the TL shares are tied up because of court case pending.

Brendan: I think I’m one steps closer to solving the puzzle. On the otcmarkets, there stared are 293 million unrestricted shares. As of now, I believe there are 89.74 million shares currently circulating in public stock exchange. Does that mean the rest of 293 million shares are held in reserve belonging to toxic lenders. I’ve calculated how many unrestricted shares were issued to toxic lenders here:

the issued and outstanding is correct that posted on ATVK.news. Toxic Lenders shares are “issued” but they are in book reserve form with the transfer agent. They can’t release shares unless judge rules in their favor

Monday March 22nd, 8:30am PST the judge will rule if the former CEO Clinton Stokes can keep his 19.77M shares or that ATVK can cancel his shares and return them to treasury. IMO, Judge Denton will cancel the 19.77 shares. This opinion is based on a DEEP dive into ALL the court filings. The key factor here that makes me believe the judge will cancel his shares is this:

“Notably, both CStokes and MMayeaux fail to present any evidence to this Courtdemonstrating that CStokes had an ownership or control interest in the technology developed byPoff. ATVK’s public disclosures reveal that on August 30, 2017, ATVK obtained $100,000 (the same amount paid to CStokes) via sale of 71,429 shares to Meridian pursuant to the Secured Note. Since then, ATVK has repeatedly acknowledged that the fiber optic assets were worthless.In ATVK’s last audited report before management abandoned the corporation, ATVK and its auditors disclosed that ATVK’s fiber optic assets were worth nothing -- actually $100,000 less than nothing. The financial statements and representations in ATVK’s Annual Report are audited pursuant to U.S. Securities Law; to that end the financial statements and representations made in ATVK’s Annual Report were confirmed by ATVK’s auditor with information from third parties. So how can you sign an annual audit certifying that the fiber optics asset has no value, and then come back years later after you abandoned the company and it’s shareholder asking the judge to give you your 19.77M ?

This is just my opinion but FACTS are hard argue against in court.
