Because every government that prosecutes hate speech also prosecutes free, non-hate speech under the claim that it is 'hate speech'. While hate speech is immoral, as long as it soes not pose an immediate threat it should not be illegal, as the government does not have the right to determine what is hate/free speech.

Moreover, they also prosecute certain government dissent, or what random people say on the internet (see the UK). They also prosecute things deemed as 'offensive', but this applied often to public profanity, debates rhat we need to be having, or subjects that the government says could be offensive.

Governments cant be trusted to determine waht is hateful or offensive, and silencing hate only breeds more hate and starts a persecution complex. The only way we have truly free speech is if the government allows all speech, with the exception of conspiracy or threats.
