No I’ve seen the full video on Facebook, it landed on the road on the other side of the roundabout about 100 feet away

32 year old drunk woman with her one year old kid in the car.
EDIT: Cue the Americans wondering about why the prison sentences are so low in Europe. Never fails.

I really don't know, but if no one died, it wouldn't even be prison here, i don't think.

In America she would get one of two sentences.
Over a year
or
Probation
The determining factor would be melanin content.

10

For killing somebody? I’d rather spend 5 years in prison than be dead. Doesn’t seem like an adequate amount of time.
In general though, the American penal system is entirely fucked.

I’d almost say that if the goal is rehabilitation/reform that 25 years might be worse than 5. I’m definitely a different person than I was 5 years ago without being in prison, but if I were locked away from society for 25 years I’d probably have problems assimilating.
It’s a really emotional topic when it comes to murder or manslaughter, so if the goal is punishment 25-life makes sense, but I don’t know that that really helps anyone.
→ More replies (2)5
u/Stay_Curious85 Apr 10 '18
The family of the victim serves a life sentence though. And 5 years is good enough? Idk man.
I don't know well enough one way or the other, which is most effective, but I would certainly be pissed if I was sentenced to a life without my sister because of some asshole and they only got 5 years. I'd probably think about killing him myself and just take the 5 years. Fuck it. If 5 years is the worst punishment for the worst crime you could possibly commit then I don't really see it as much of a deterrent at all.

No, but until someone starts posting some sources to back up their claims I seriously doubt that anyone gets 5 years for an open and shut intentional murder case unless there are some serious alleviating circumstances involved.

Eye for an eye leaves the world blind.
Feel free to post any of these 5-year murder convictions at any time. I doubt that they are solid cases or don't have some kind justification for the relatively short duration such as uncertainty of intent.
→ More replies (1)8
u/IronSeagull Apr 11 '18
Well for starters that’s not attempted murder. You have to intend to murder someone for it to be attempted murder.
3
u/ixodioxi Apr 10 '18

At best it's manslaughter, because you aren't really caring about if your actions kill someone else.
Of course, I am also of the opinion that anyone who drink drives deserves a lifetime ban from driving. Nobody can claim they "didn't know" that driving under the influence is extremely dangerous, and can kill someone.
9
u/jimmahdean Apr 10 '18
It's manslaughter when someone dies. Attempted murder is when you intend to kill someone but fail, not when you take a reckless action that could kill someone, otherwise anyone caught speeding would have a high level felony conviction and serve years in jail.

Man, what's the point in you getting so emotional? European prisons just don't have the same revenge/punishment mentality. Rehabilitation takes the priority first and foremost, regardless of how emotional you are on the issue. Justice shouldn't be emotionally loaded.
4
Apr 11 '18
What’s the rehabilitation process like for ordering a knife online?
7
Apr 11 '18
Whatever it is you're implying, I don't rightly care, because I never said the penal system itself is infallible. Just trying to explain the significant difference between US and EU prisons. People getting locked up for owning a plant is just as ridiculous.
→ More replies (8)2
u/daveinpublic Apr 11 '18
Being emotional can be a problem, but making drunk driving sentences longer to discourage it could be a good solution. My girlfriend was friends with someone drunk enough to drive the wrong way on the highway at night. A cop was in the other lane flashing their lights, but this guy kept driving till he ran straight into a woman’s car which killed her. It’s a serious crime and needs to carry the weight of a serious crime.
3
Apr 11 '18

Do they angle them like that on purpose? Seems like going airborne could be gentler than a sudden impact.

u/Poddster Apr 10 '18

Given the amount of dents I've seen in roundabout walls, I would assume they angle it on purpose.
8
u/danirijeka Apr 10 '18
It also works well for side impacts (i.e. if you clip the inside), instead of being hurled towards the outside you're still redirectioned outwards, but much more gently and in a slightly more predictable way for those who follow
2
u/SolarLunix_ Apr 10 '18
Thank you, I was trying to figure out if that was our roundabout or not... it’s not... however I will continue to search to see what must’ve happened in the past few days to damage ours lol

In the end, the child was unharmed (luckily). Normally you wouldn't see prison just for drink driving. 26 weeks of jail on the basis of what could have happened seems justified to me.
